CRAUN, by and through their attorney, Marci S. Miller, Esquire, of Gibbel Kraybill & Hess LLP, and file the within Petition to Withdraw, and in support hereof, aver as follows: 1. Esther H. Byers, deceased, passed away on November 29, 2011. 2. Esther H. Byers was not married at the time of her death. Her husband, John A. Byers, predeceased her on October 16, 2007. 3. Esther H. Byers was survived by her four (4) children. The names and address of Esther H. Byers' four (4) children are as follows: Randall L. Byers (son}, of 32 North Chestnut Street, Marietta, Pennsylvania 17547; Sheryl B. Craun (daughter), of 11219 Doubletree Court, Alexandria, Kentucky 41001; Brenda S. Cox (daughter), of 21604 320"' Street, Ollie, Iowa 52576; and Pamela L. Musser (daughter), of 54 Penn Street, Washington Boro, Pennsylvania 17582. Esther H. Byers did not have any children who predeceased her. 4. On December 6, 2011, Petitioners, Randall L. Byers and Sheryl B. Craun, filed a Petition for Probate and Grant of Letters Testamentary in the Office of the Register of Wills Office of Cumberland County, Pennsylvania. Atime-stamped copy of the Petition is attached hereto as Exhibit "A." ti ~ 5. Contemporaneous with filing the Petition for Probate and Grant of Letters Testamentary, Petitioners offered for probate a photocopy of a Will for Esther H. Byers dated December 14, 2007 and an original Codicil thereto, dated September 22, 2011. Copies of the Will dated December 14, 2007 and the Codicil dated September 22, 2011 are attached hereto as Exhibits "B" and "C" respectively. 6. Because Petitioners could not locate the original Will of Esther H. Byers dated December 14, 2007 that was offered for probate, the four (4) children of Esther H. Byers each received a Citation from the Register of Wills Office to show cause why the photocopy of the 2007 Will should not be admitted to probate as the Last Will and Testament of Esther H. Byers, along with the Codicil dated September 22, 2011, and Letters Testamentary granted to Randall L. Byers and Sheryl B. Craun, as Co-Executors. A hearing was scheduled for January 11, 2012 at 3:00 p.m. 7. The intestate heirs of Esther H. Byers are her four (4) children. The beneficiaries under the Will of Esther H. Byers dated December 14, 2007 and Codicil thereto are her four (4) children, equally. 8. The sole probate asset of the Estate of Esther H. Byers is a PNC Bank checking account with a date of death balance of approximately Nine Thousand Dollars ($9,000.00). 9. Because the beneficiaries of the Estate of Esther H. Byers are the same under the Pennsylvania intestacy statute as under her December 14, 2007 Will offered for probate, Petitioners desire to save the time and expense of proceeding with a hearing on January 11, 2012 and request to withdraw their Petition for Probate and Grant of Letters Testamentary filed in this matter with the Office of the Register of Wills of Cumberland County, Pennsylvania on December 6, 2011. 2 ti ~) 10. All beneficiaries under the Will of Esther H. Byers dated December 14, 2007 and the Codicil thereto dated September 22, 2011, and all intestate heirs of the Estate of Esther H. Byers join with the Petitioners in their request to withdraw the Petition for Probate and Grant of Letters Testamentary. The signed Joinders of all interested parties in this matter are attached hereto collectively as Exhibit "D." 11. Petitioners have filed along with this Petition a Petition for Probate and Grant of Letters of Administration. Pamela L. Musser, Brenda S. Cox and Sheryl B. Craun have renounced their right to administer the Estate of Esther H. Byers in favor of Randall L. Byers. A copy of the Petition for Probate and Grant of Letters of Administration and the signed Renunciations of Pamela L. Musser, Brenda S. Cox, and Sheryl B. Craun are attached hereto as Exhibit "E." WHEREFORE, Petitioners respectfully request the Court to withdraw the Petition for Probate and Grant of Letters Testamentary dated December 1, 2011 and filed with the Office of the Register of Wills of Cumberland County, Pennsylvania in the Estate of Esther H. Byers on December 6, 2011, and cancel the hearing in this matter currently scheduled for January 11, 2012.
