RECEIPT. RELEASE. REFUNDING AND INDEMNIFICATfON AGREEMENT
The undersigned, Janelle E. Egan, a beneficiary of the Estate of Eris J. Kann, deceased,
does hereby:
1. Acknowledge that she has examined and approved the First and Final Account of
Timothy P. Kann, Executor of the Estate of Eris J. Kann;
2. Acknowledge receipt of all assets to which she is entitled under the Distributions
to Beneficiaries and/or Proposed Distributions to Beneficiaries sections of the First and Final
Account;
3. Release Timothy P. Kann and each of his heirs, personal representatives,
successors and assigns from all liabilities, whether due to the Executor's negligence or
otherwise, which she may have by reason of the Executor's administration of the estate;
4. Agree to refund to the Executor any portion of the distribution to which she is not
properly entitled and, to the extent of said distribution, to indemnify Timothy P. Kann for claims
against him as Executor and to reimburse to him all expenses and costs (including attorney's
fees) incurred in connection with any such claims; and
5. Declare that this instrument shall be legally binding upon her, her personal
representatives, successors, and assigns.
