THE FOLLOWING NOTICE IS BEING PROVIDED PURSUANT TO THE FAIR DEBT
COLLECTION PRACTICES ACT, 15 U.S.C. 1601:
The undersigned attorney is attempting to collect a debt owed to the
Plaintiff, and any information obtained will be used for that
purpose, The amount of the debt is stated in this Complaint.
Plaintiff is the creditor to whom the debt is owed. Unless the
Debtor, within thirty (30) days after your receipt of this notice
disputes the validity of the aforesaid debt or any portion thereof
owing to the Plaintiff, the undersigned attorney will assume that
said debt is valid. If the Debtor notifies the undersigned attorney
in writing within the said thirty (30) day period that the aforesaid
debt, or any portion thereof, is disputed, the undersigned attorney
shall obtain written verification of the said debt from the Plaintiff
and mail same to Debtor. Upon written request by Debtor to the
undersigned attorney within said thirty (30) day period, the
undersigned attorney will provide debtor with the name and address of

1. Plaintiffs, John D. Majeski and Darlene H. Majeski,
are adult individuals who reside at 404 Hemmingway Drive, Bel Air,
Maryland 21014.
2. Defendants, Jerry Wagner and Ginger Wagner, are
adult individuals whose last known address is 614 North High
Street, Duncannon, Pennsylvania 17020,
3. On or about January 30, 1998, Plaintiffs and
Defendants entered into a Residential Lease Agreement, a copy
attached hereto and made a part hereof as Exhibit "A".
4. The leased premises is known as 754 Erford Road,
Camp Hill, Pennsylvania 17011 ("Property").
5. In accordance with the terms of the Lease,
Defendants were required to make monthly rental payments of
$625.00,
6. Defendants were further required to cause no damage
to the property and to pay to repair any damage to the property
cause through lack of care.
7. On or about December 5, 2000, following notice to
quit given by Plaintiffs, the Defendants vacated the property.
8 . Defendants intentionally left the property in a
deplorable and disgusting condition having caused substantial
damage throughout the house, including but not limited to, walls,
drywall, wallpaper, kitchen floor, carpeting, medicine cabinet,
railing, doors, stove, furnace, hot water heater and hardwood
floors.
9. The cost to repair the property is as follows:

TO THE PLAINTIFFS' COMPLAINT
AND NOW, this 2ih day of August, 2002, comes the Defendants, JERRY WAGNER
and GINGER WAGNER, by and through their attorneys, Irwin, McKnight & Hughes, and
make the following Answer with New Matter and Counterclaim to the Complaint filed by
Plaintiffs, JOHN D. MAJESKI and DARLENE H. MAJESKI, averring as follows:
1.
The averments offact contained in paragraph one (1) of the Complaint are admitted.
2.
The averments of fact contained in paragraph two (2) of the Complaint are admitted.
3.
The averments off act contained in paragraph three (3) of the Complaint are admitted.

The averments of fact contained in paragraph four (4) of the Complaint are admitted.

The written lease attached as Exhibit "A" speaks for itself and therefore no response is
required. Any discrepancies between the avennents in paragraph five (5) and the Lease are
specifically denied and strict proof thereof is demanded at trial.

required. Any discrepancies between the avennents in paragraph six (6) and the Lease are
specifically denied and strict proof thereof is demanded at trial.

The avennents of fact contained in paragraph seven (7) of the Complaint are denied as
stated. It is admitted that Defendants were given an improper notice to quit and they
subsequently vacated the property. By way of further answer, Defendants vacated the property
in part due to Plaintiffs failure to maintain the property in accordance with the written lease,
despite repeated requests by Defendants for necessary repairs. The remaining avennents in
paragraph seven (7) are specifically denied and strict proof thereof is demanded at trial.

The avennents of fact contained in paragraph eight (8) are conclusions of law to which
no response is required. To the extent a response is required, the avennents are specifically
denied and strict proof thereof is demanded at trial. By way of further answer, the failure of
Plaintiffs to make repairs under the tenns of the Lease Agreement despite repeated requests by
Defendants caused the deplorable living condition to which Defendants were subjected.

The averments of fact contained in paragraph nine (9) of the Complaint are specifically
denied and strict proof thereof is demanded at trial.

The averments of fact contained in paragraph ten (10) of the Complaint are specifically
denied and strict proof thereof is demanded at trial. By way of further answer, Plaintiffs were
informed on more than one occasion that Defendants would withhold rental payments until the
property was repaired and made habitable.
11.
The averments of fact contained in paragraph eleven (11) of the Complaint are
conclusions of law to which no response is required. To the extent a response is required, the
averments are specifically denied and strict proof thereof is demanded at trial.
WHEREFORE, Defendants Jerry Wagner and Ginger Wagner respectfully requests that
this Court enter a judgment in their favor and against Plaintiffs in this matter, John D. Majeski
and Darlene H. Majeski, together with reasonable costs, attorney fees, and such other and further
relief as this Court deems just.

NEW MATTER
12.
The averments of fact contained in the Answer to the Complaint are hereby incorporated
by reference and are made part of this New Matter to the Complaint of the Plaintiff.
13.
In accordance with the Lease Agreement, Plaintiffs were required to keep in good
working order all systems, services, facilities, and appliances supplied by the them within the
Property, including but not limited to, the furnace and hot water heater.
14.
In accordance with the Lease Agreement, Plaintiffs were required to keep m good
working order all structural parts of the Property including but not limited to floors, walls, and
steps.
15.
Defendants Jerry Wagner and Ginger Wagner, on numerous occasions both by telephone
and through written correspondence, requested that Plaintiffs John D. Majeski and Darlene H.
Majeski maintain the property in accordance with the Lease Agreement.
16.
Plaintiffs repeatedly told Defendants that they would come to the Property when they
were in the area to inspect the premises.

Upon information and belief, Plaintiffs only came to the Property on one occasion while
Defendants were living there, at which time Plaintiffs simply left a note indicating that they had
been to the premises.
18.
Despite being given timely and frequent notice of the problems and defects with the
property and despite repeated requests to maintain the property, Plaintiffs failed to make the
necessary repairs to maintain the property in accordance with the Lease Agreement.
19.
Due to Plaintiffs repeated failures to address the problems and defects, Defendants also
contacted officials in East Pennsboro Township raising their concerns with the maintenance of
the Property.
20.
Due to Plaintiffs repeated failures to address the problems with the property and in hopes
of stimulating Plaintiffs to properly address said problems, Defendants informed the Plaintiffs
that they were going to withhold monthly rental payments until the defects were addressed.
21.
By virtue of repeatedly ignoring Defendants' requests for repairs, Plaintiffs created an
uninhabitable environment.

Plaintiffs therefore breached the warranty of habitability implied in all residential lease
agreements in Pennsylvania.
23.
The uninhabitable conditions included, but are not limited to the following defects:
a. Flooding in the basement, that on at least one occasion destroyed numerous
clothes and pictures owned by the Defendants;
b. Mold in the basement and other areas that destroyed the hardwood flooring and
carpeting and detrimentally affected the health of the Defendants and their
children;
c. Defective hot water heater whose pilot light continually went out presumably as a
result of it leaking; and
d. Animal and rodent infestation presumably caused by the abandoned premises
which is connected to the subject Property.
WHEREFORE, Defendants Jerry Wagner and Ginger Wagner respectfully requests that
this Court enter a judgment in their favor and against Plaintiffs in this matter, John D. Majeski
and Darlene H. Majeski, together with reasonable costs, attorney fees, and such other and further
relief as this Court deems just.

COUNTERCLAIM
24.
The averments of fact contained in Defendants Jerry Wagner and Ginger Wagner
Answers to the Complaint and New Matter above are hereby incorporated by reference and are
hereby made part of this Counterclaim.
25.
As a result of the mold that was present at the Property, Defendants and their children
experienced respiratory and related health problems.
26.
Defendants attempted on several occasions to remove and/or clean the mold growing at
the Property in order to reduce the detrimental health effects, but were unsuccessful.
27.
Plaintiffs refused and failed to remove or otherwise remedy the mold growth present at
the Property in violation of their duties, both express and implied, under the Lease Agreement.
28.
Furthermore, as a result of both the mold and the flooding of the property, numerous
personal property of Defendants was damaged or destroyed.
WHEREFORE, the Defendants, Jerry Wagner and Ginger Wagner, demand judgment
against the Plaintiffs, John D. Majeski and Darlene H. Majeski, in an amount less than the

arbitration limit of twenty-five thousand dollars ($25,000,00) Dollars, plus costs, interest, and all
other relief this Court deems fair and just.

1. The prior Order of Court dated September 23, 2003 shall remain in full
force and effect with the following modifications and additions:
2. During the school year, Mother shall have physical custody of the children
two weekends per month, in most instances on an alternating basis. However, in the
event Mother's weekend military training conflicts with one of her scheduled weekends,
the parties shall cooperate to change Mother's weekends so she will have two weekends
per month. In this regard Mother shall provide Father with her weekend military
schedule in advance.
3. The children shall only be transported by licensed drivers.
4. Custody arrangements are to be discussed by the parents. Neither party
may use the children to exchange custody arrangements and/or messages.
5. The children are not to be left in the car for longer than 5 minutes.
6. Father shall provide Mother a copy of the insurance prescription card.
7. Parents, step-parents, and other third parties are not permitted to listen in
on telephone calls between the parents and children.
8. This Order is entered pursuant to an agreement of the parties at a Custody
Conciliation Conference. The parties may modify the provisions of this Order by mutual
consent. In the absence of mutual consent, the terms of this Order shall control. Another
Conciliation Conference is scheduled for September 16, 2005 at 3:30 p.m. at which time
the Conciliator will speak with the children. Neither party may discuss the custody
matter with the children, nor attempt to influence the children in their discussion with the
Conciliator.
