LLC Contractor IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA z00z STIPULATION AGAINST LIENS DORAN PROPERTIES, LLC, a Pennsylvania limited liability company (hereafter "Owner"), has executed a contract dated Nov~ber 28, 2001, with Bolger Bros. LLC (hereafter "Contractor") for the construction of a one-story office building situate on the property, 3906 Market Street, Hampden Township, Cumberland County, Pennsylvania, which is more particularly bounded and described on Exhibit "A," attached hereto and made part hereof. NOW, this /~'~-~-- day of January, 2002, in consideration of the making of the said contract with Owner and the further consideration of One Dollar ($1.00) to Contractor paid by Owner, it is agreed that no lien shall be filed against said improvements or the property by the Contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the building, the right to file such liens being expressly waived. .012427-00001 / 1.18.02/EGM/DCP/153807 IN WITNESS WHEREOF, the parties hereto, by their duly authorized representatives intending to be legally bound hereby, have caused these presents to be duly executed on the day and year first above written. Title: . 012427-00001/1.18.02/EGM/DCP/153807 EXHIBIT A ALL THAT CERTAIN piece or parcel of land situated in the Township of Hampden, County of Cumberland and Commonwealth of Pennsylvania, and lying on the north side of Carlisle Pike, more particularly bounded and designated as the tract of land containing 1.14 acres of land on a certain survey made by John C. Brilhart, Registered Surveyor, on August 5, 1968, as follows, to wit: BEGINNING at a point in the center of Carlisle Pike, said point being located and referenced at a distance of 808.20 feet measured along the center line of said Carlisle Pike in an eastwardly direction from Orr's Bridge Road; THENCE North 12 degrees 55 minutes 35 seconds West along other lands of Milewski herein, a distance of 349 feet to a point at the Conodoguinet Creek; THENCE along said Conodoguinet Creek, South 87 degrees 39 minutes 25 seconds East a distance of 153.84 feet to a point on the same at the line of lands now or formerly of C. Lester Emmert; THENCE along said lands now or formerly ofC. Lester Emmert, South 13 degrees 15 minutes East a distance of 316.60 feet to a point in the center of Carlisle Pike aforesaid; THENCE along the center line of said Carlisle Pike, South 79 degrees 56 minutes West a distance of 146.68 feet to a point in the same, the point and place of BEGINNING. CONTAINING 1.14 acres of land. See Subdivision Plan recorded in Plan Book 20, Page 31. BEING THE SAME PREMISES which Doranco, Inc., a Pennsylvania business corporation, by deed dated November 7, 2001, recorded in the Office of the Recolder of Deeds of Cumberland County in Deed Book 249, Page 1158, granted and conveyed unto Doran Properties, LLC.
