IN ESTATE OF EUGENE H. POTTEIGER. DECEASED
KNOW ALIL MEN BY THESE PRESENTS, that:
WHEREASj, Eugene H. Potteiger ("Decedent"), late of Hampden Township, Cumberland
County, Pennsylva fiia, died testate on March 22, 2010:
WHEREAS Letters Testamentary on the Estate of the Decedent were duly issued by the
Register of Wills ojf Cumberland County, Glenda Famer Strasbaugh to the Executrix, Cindy L.
Moyer on April 1, 210;
WHEREAS the Executrix has gathered the assets of the Estate of the Decedent and the
assets consist of personal property with a total liquidation value of $533,599.49 as set forth in the
Statement of Accoujnt attached hereto and marked Exhibit "A' ;
WHEREAS, the Executrix has paid the debts of the Decedent and the administrative
expenses of the Estate in the total amount of $64,791.73, as set forth in the Statement of Account;
WHEREAS,I the net probate Estate is valued at $465,184.04 consisting of gross probate
assets ($529,975.70 minus debts and administrative expenses ($64,791.73);
WHEREAS,I the April 9, 2010 liquidation value of the Decedent's Personal PNC Bank
Checking Account ~Jo. xx-xxxx-8178 was $203,470.23, as identified on the Statement of Account,
which amount differed from the March 22, 2010 date of death balance of $204,483.65 reported on
the Inheritance Taxi Return because of the following three checks which cleared post-death: (1)
Purcell, Krug & Haller - NMSO attorney's fees for $168.75; (2) Wayne Moyer -reimbursement for
medical expenses advanced for $777.21; and (3) Connor & Rich -medical services for $95.25;
plus accrued interest of $27.79;
WHEREAS, at the time of his death, the Decedent co-owned with his son, Gary E.
Potteiger, as joint, tenants with the right of survivorship, 5.642 of vacant acreage identified as
Cumberland Coun~y Tax Parcel No. 38-22-0144-075 evidenced by a May 8, 2008 Deed recorded
on May 13, 2008 ~s Instrument No. 200815808. Upon the death of the Decedent, title to the non-
probate real estate) passed to Gary E. Potteiger by operation of law;
WHEREA~, pursuant to Item IV of the Decedent's Will, a specific monetary bequest of
$5,000.00 was distributed to Roxbury Holiness Camp and was acknowledged on June 1, 2010 by
Charles L. Lehman, the Treasurer for Roxbury Holiness Camp. A true and correct copy of the
notarized Acknowledgment of Specific Bequest, executed by Charles L. Lehman, Treasurer is
attached hereto and marked as part of Exhibit "B";
WHEREAS, pursuant to Item V of the Decedent's Will, a specific monetary bequest of
$10,000.00 was d#stributed to the Decedent's grandson, Adam Putt and was acknowledged on
May 19, 2010 by Adam Putt. A true and correct copy of the notarized Acknowledgment of Specific
Bequest, executed by Adam Putt is attached hereto and marked as part of Exhibit "B";
WHEREAS, pursuant to Items V and VI of the Decedent's Will, the Decedent's personal
property was distributed in kind to Cindy L. Moyer and the Decedent's flag was distributed in kind to
Adam Putt;
WHEREAS, pursuant to Item III of the Decedent's Will, the Brethren in Christ Church of
Mechanicsburg, PA is entitled to $46,518.40 which is ten percent of the net value of the Decedent's
probate Estate, (g)ross date of death value of the probate assets minus Decedent's debts and
Estate administrati{/e expenses), as set forth on the Statement of Distribution attached hereto and
marked Exhibit "E~. This FSA&FR; a copy of the Inheritance Tax Return; and correspondence
from counsel for tFje Estate itemizing the net value of the probate Estate were provided to Deputy
Attorney General Jlohn Downing at the PA Attorney General's office for review prior to the FSA&FR
being executed by (Brethren in Christ Church of Mechanicsburg;

WHEREAS,, pursuant to Item VIII of the Decedent's Will, the Executrix obtained an
appraisal performep by a certified real estate appraiser for the vacant acreage identified as 10 York
Circle, Mechanicsfaurg, PA 17050, Cumberland County Tax Parcel No. 38-22-0144-075 and co-
owned on the Dec dent's death by Decedent and his son, Gary E. Potteiger, as joint tenants with
right of survivorship. The vacant 5.642 acres was appraised for a value of $112,500.00. Attached
hereto and marked Exhibit "D" is a true and correct copy of the appraisal of the real property
performed by Chrisikopher Jones, SRA with Robert R. Jones & Associates;
WIiEREAS,j pursuant to Item VIII of the Decedent's Will, the amount of $56,250.00 or one-
half of the appraise! value of Cumberland County Tax Parcel No. 38-22-0144-075 is to be divided
in equal shares am~ng the Decedent's five children, Gary E. Potteiger, James N. Potteiger, Jae A.
Potteiger, Sue A. Farley and Cindy L. Moyer, resulting in each of the five beneficiaries receiving
$11,250.00 as set f~rth in the Statement of Distribution attached hereto and marked Exhibit "E";
WHEREAS,Ithe amount of $10,000.00 has been reserved to pay for accountant fees; 2011
income tax liabilitie$; any additional attorney's fees; and any additional administrative expenses
incurred by the Esta~e. The reserved monies will be held in anon-interest bearing Trust Account at
Purcell, Krug & Haber, counsel for the Estate. Once counsel for the Estate determines that the
reserved funds are not needed, the balance remaining from the reserve will be distributed to the
Decedent's five chil~ren, as the residuary beneficiaries, in proportionate shares in compliance with
Item X of the Deced~nt's Will;
WHEREAS, II, the balance for residuary cash distribution is the amount of $338,119.36,
which will be distrif~uted in accordance with the Statement of Distribution attached hereto and
marked Exhibit "E' ;
WHEREAS, ~he residuary beneficiaries of the Decedent's Estate are his five children and
pursuant to Item X ~re entitled to the following shares of the Decedent's residuary Estate as set
forth on the Statement of Distribution attached hereto and marked Exhibit "E":
a) Gary E. Potteiger -one-fifth of the residuary Estate ($67,623.87), less a sum equal
to fprty percent of the value of 10 York Circle (40% x $112,500.00 or $45,000.00);
b) After calculating and subtracting Gary E. Potteiger's share, the residuary balance is
to bile distributed equally among James N. Potteiger, Jae A. Potteiger, Sue A. Harley
and Cindy L. Moyer;
WHEREAS!, each of the Decedent's five children, Gary E. Potteiger, James N. Potteiger,
Jae A. Potteiger, ~ue A. Harley and Cindy L. Moyer previously acknowledged in writing their
individual receipt o~ partial cash distributions of $20,000.00 each. True and correct copies of the
notarized Acknowledgments of Partial Distribution executed by each of the five children, are
attached hereto and marked Exhibit "C".
NOW, THI~REFORE, we, Brethren in Christ Church, Gary E. Potteiger, James N.
Potteiger, Jae A. Potteiger, Sue A. Harley and Cindy L. Moyer, do hereby acknowledge that we
have received the I~quidated proceeds of the assets due us by virtue of the Decedent's Last Will
and Testament as het forth on the Statement of Distribution.
AND, we dc~ hereby stipulate that in order to avoid the expense and time involved in the
filing of a formal Alccount and Schedule of Proposed Distribution, we agree that no formal
Account and Schedule of Proposed Distribution are necessary and we consent to distribution
being made without the formal filing of such documents. The Family Settlement Agreement and
Final Release will ~e with the same force and effect as if the document had been filed and
confirmed by the Cumberland County Orphans' Court Division.
THEREFOt~IE, we do hereby release, indemnify and forever discharge and hold
harmless the Exec,~utrix, Cindy L. Moyer; and the Attorneys for the Estate, Jill M. Wineka,
Esquire and the laver firm of Purcell, Krug & Haller, their assigns, executors and administrators,
from all actions, sums, payments, accounts, and claims whatsoever, touching upon the Estate of
the Decedent.

The parties acknowledge that this Family Settlement Agreement and Final Release will be
signed and notarizled separately by each of the aforementioned six beneficiaries. The six original
signatures will be'attached to the original Family Settlement Agreement and Final Release and
filed of record with ~he Cumberland County Register of Wills.

204.1 Pur tos -This Zone is meant to accommodate suburban detached residential growth
', within the l'ownship. This 7.one coincides with potential sewer and water utility
service areas; however, the actual availability nfthese services is likely to occur at
'~ different times, in different areas. As a result, permitted densities have been adjusted
according to the availability of these public utilities. All uniis that are proposed without
the use of public utilities will be required to be situated to one side of a wider tat so that
future in-fall development potentials can be protected when public utilities becrnme
~I available.
In accordance with local planning goals that were developed within the Township's
Comprehensive Plan, developments within this 'Lone will be encouraged to engage a
prroper site plan review process. Such process will lx: used to help preserve any
significant natural features or areas of severe development limitation. Additios><~ally,
some provision ol'eommon open space will he encouraged to help retrofit needed
neighborhood and linear parklands, as suggested within the'1'ownship's Comprehensive
Recreation and Open Slydce Plan.

quirements for "Housing for Older Persons" as specified in the United States ('cxle. (Nate

C3. In ardor to be approved by the Township as Age Restricted Residential Development, every
dwelling unit (except a unit for one manager) on a tract of land shall be permanently
'restricted by deed, by any Lase and by Hates on the recorded plan to the fallowing

required.

subdivision or land development submission. Any subdivision plan for a new tat
shall show the outer Ixtundaries of the proposed principal building site. Any
applicant may legally commit on the subdivision plan to not construct any
!, principal building at portions of the lot with greater than 25 percent slope in order
', to avoid the larger lot requirements ofthis Section.
2. This Subsection 204A shall not apply to: I) a lot drat lawfully existed prior to the
adoption of this Section, 2) slopes that the upplicant proves were clearly man-
made prior to the enactment ofthis Subsection, ur 3) if the building intrudes into
