Vogelsong, by and through her attorney, Richard Koch, and avers the following: 1. Admitted. 2. Denied. The plaintiff's Exhibit A states that the "borrower is the mortgagor under this Security Instrument." Ex. A at 1. On the signature page, next to the defendant Tina Vogelsong's typed name is the phrase "Non-Borrower". Ex. A at IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY NO. 12-167 13. The same phrase is typed next to the defendant's name below her signature on the Prepayment Rider. Ex. A at 18. If Tina Vogelsong is not a borrower according to the plaintiff, and the plaintiff defines a `borrower' as a 'mortgagor', then Tina Vogelsong is not a legitimate defendant in a Mortgage Foreclosure action according to the plaintiff's own evidence. By way of further answer, Defendant Tina Vogelsong does not currently reside at 36 King Drive, Carlisle, Pennsylvania. She has not resided there for twenty years. By way of further answer, Ms. Vogelsong is part owner of the property at issue by virtue of her late father's ownership of the property. 3. Admitted, to the best of information and belief. 4. Admitted, to the best of information and belief. 5. Admitted, to the best of information and belief. Ms. Vogelsong is not a mortgagor, so this paragraph has no applicability to her. 6. Admitted, to the best of information and belief, though the paragraph has no applicability to Ms. Vogelsong. 7. Neither admitted nor denied. Ms. Vogelsong is not a borrower on the mortgage and has no knowledge of the legal description of the property at issue. 8. Neither admitted nor denied. Since she was never a borrower on the mortgage, Ms. Vogelsong has no knowledge of precise payments made or missed on the mortgage on the property at issue. 9. Neither admitted nor denied. Ms. Voglesong has no independent knowledge of any amounts due or owing on the mortgage in question, in part because she was never a borrower. 2 10. Neither admitted nor denied. Plaintiff does not have an accurate address for Ms. Vogelsong, so she cannot confirm that Notice of Intention to Foreclose was mailed. 3 WHEREFORE, Defendant requests this Court order the Plaintiff to amend the Complaint to remove Tina M. Vogelsong as a Defendant. In the alternative, this Court should dismiss the complaint for failure to state a claim against Defendant Tina M.
