Liddick, by and through his attorney, Steven R. Snyder, ~.- Esquire, hereby Petitions this Orphans' Court to issue a Citation directed to Respondent, Wayne Liddick to show cause why Letters of Administration should not be issued to Donald R. Liddick as Administrator and in support thereof avers the following: 1. An Estate in the above-captioned matter was attempted to be opened October, 2011 by Mr. Donald R. Liddick after the passing of his sister, Lorraine A. Goforth, who died intestate. 2. All of the requisite paperwork was forwarded to the Register of Wills of Cumberland County to open the estate. 3. All of the documentation required to open the estate was provided to the Register of Wills except the Renunciations signed by the deceased's heirs allowing Donald to act as Lorraine's Administrator. 4. Respondent Wayne Liddick, Mrs. Goforth's other brother is currently serving a life sentence at SCI-Frackville. 5. Petitioner sent a Renunciation to the Respondent on several occasions with letters of explanation and spoke with Respondent's counselor at the State Correctional Institute, Mr. Rerick, for help explaining the situation to Respondent. 6. Respondent has refused to sign the Reunification allowing his brother Donald to handle his sister's estate. WHEREFORE, Petitioner respectfully request that this Honorable Court award a Citation pursuant to the provisions of §764 of the Pennsylvania Probate, Estates and Fiduciaries Code, 20 Pa. In order for my office to open an estate and pay all of the bills incurred by your late sister, you and your brother, David must sign a Renunciation. That said, it is my understanding from your counselor at Frackville SCI that you would like me to explain to you exactly what you aze signing. The Renunciation, once signed, is a document that allows one relation of the deceased to open an estate. This in no way means you are giving up any of your rights regazding the estate, it just means you aze allowing your brother to open the estate so that the bills can be paid from an estate checking account. I hope this explains the document sufficiently for you so you will sign and return the notarized Renunciation to my office so that an estate can be opened. In your letter you write to ask if you are named in your sister Lorraine's will. As I had tried to explain to you in my previous correspondence, your sister died without a will. The purpose of the renuncification form is to allow your brother to open up an estate for your sister and to handle her final affairs. Your sister Lorraine died with very little personal effects. My understanding is that she owned an old trailer that she lived in and an old automobile and other than that most of the estate consists of past bills that need to be paid. Essentially our office has been retained to help handle issues for Lorraine's estate and if any money is left over at the end it will be divided equally among the three remaining brothers including you. Again, Lorraine has no will. The reason for the renunciation form is to allow your brother Donald to be in charge of making sure that Lorraine's final affairs are taken care of and to allow him to open up an estate at the Cumberland County Courthouse. In signing the renuncificationynu in no way give up your right to any of Lorraine's estate which may be left after all bills are paid.
