STIPULATION AGAINST LIENS
THIS AGREEMENT made the 17TH day of JANUARY, 2002
by and between MICHAEL MANNING & ASSOCIATES
hereinafter referred to as Contractor,
AND
JOHN S. LIPNICKY AND HOLLY A. HANEVICI~ LIPNICKY
hereinafter referred to as Owner, whereby the former undertook and agreed to construct a
single family dwelling, in CUMBERLAND COUNTY, PENNSYLVANIA, KNOW AS LOT #39 KENT DRIVE,
ENOLA, PA 17025
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and
in consideration of the sum of Dollar to it in hand paid
by Owner, the receipt whereof is hereby acknowledged, and the further consideration
mentioned in the agreement aforesaid, for themselves and their subcontractors, and all
parties acting through or under them, covenant and agree that no mechanic,s liens or
claims shall be filed or maintained by them or any of them against the said buildings and
the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or
about the erection and construction of the said buildings on the lot above described, and
the said Contractor, for themselves, their subcontractors and others under them hereby
expressly waive and relinquish the right to have, file, and maintain any mechanic,s liens
or claims against the said buildings or any of them, and agree that this instrument,
waiving the right of lien, shall be an independent covenant.

All that certain piece or parcel of land situate in thc Township of East Pennsboro, Cumberland
County, Commonwealth of Pennsylvania, being more fully desen'hed as follows:
Beginning at a point on the legal fight-of-way line of Kent Drive at the dividing line of Lot No.
38 and Lot No. 39, Hickory Ridge, Ph~e I, Recorded in PB 77, Pg. 143. Thence by said dividing
line, North 88 degrees 33 minutes 06 seconds East a distance of I00.00 feet to a point at the
dividing line of Lot No. 35 and lands herein desen~xt. Thence by said dividing line and beyond
by Lot No. 34 and Lot No. 33, South 01 degree 26 minutes 54 seconds East a distance of 98.14
feet to a point at the dividing line of Lot No. 40 and Lot No. 39, herein descn'bed. Thence by said
dividing line, South 88 degrees 33 minutes 06 seconds West a d/stance of 100.00 feet to a point
on the legal right-of-way line of Kent Drive. Thence by said right-of-way line, North 01 degree
26 minutes 54 seconds West a distance of 98.14 feet to a point, the place of beginning.
Being Lot No. 39, containing 9,814 sq. ff., as shown on Final Subdivision Plan of I-tiekory
Ridge, Phase I, recorded in Planbook 77, Page 143, and being subject to all easements of record.
BEING THE SAME PREMISES which Michael Manning and Associates, a Pa General
Partnership by their deed dated January ]~'~ , 2002, and about to be recorded
in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania,
granted and conveyed unto John S. Lipnicky and Holly A. Hanevich Lipnicky, h/w,
Mortgagors herein.
