WHEREAS, Steven [~ Toole and Jana B. Toole , his wife, Owners, of Susquehanna
Township, Dauphin County, Penn,ylvania, are about to execute contemporaneously herewith, a
contract, with Omni Interactive Systems, Inc., of Lemoyne, Cumberland County, Pennsylvania,
jbr the following services: installation of security and home safety systems, home theater and
Iow voltage wiring at Lot 3, Phase I, Wentworth Estates, Hampden Township, Cumberland
County', Pennsylvania:
ALL THAT CERTAIN piece or parcel of/and situate in the Township of Hampden, County of
Cumberland and Commonwealth of Permsylvania, lying along Pellingham Cimle and being
approximately 600 feet southeast of the intersection of Eaglesmoor Lane and Pellingham Circle,
bounded and described as follows, to wit:
BEGINNING at the intersection of the southerly right-of way line of Pellingham Circle (50 feet
wide) with the line of division between Lot 3 and Lot 4; extending (1) thence along said right-
of-way line, North 77° 29' 14" East, 165.00 feet; extending (2) thence along Lot 2, Phase III,
South 12 o 30' 46" East, 232.11 feet; extending (3) thence along Lot 64A, South 82 ° 02' 47"
West, 165.52 feet; extending (4) thence along Lot 4, North 12° 30' 46" West, 218.95 feet to the
place of BEGINNING.
CONTAINING 0.854 Acre.
BEING Lot No. 3 as shown on a plan entitled "Final Subdivision Plan for Phase I, Wentworth
Estates" dated 11/20/2002, last revised 4/11/2003, Job Number 1001-846, prepared by LSC
Design, Inc., York, PA and recorded in Cumberland County office of the Recorder of Deeds in
Plan Book 87, Page 50.
NOW, A~,~j~ ~ ¢ , 2004, at the time of and immediately before the
execution of the principal contract, and before any authority has been given by the said Owners
to the said Contractor to commence the said work, or purchase materials for the same in
consideration of the making of the said contract with Contractor, and the further consideration
of One Dollar, to Contractor paid by Owners, it is agreed that no lien shah be filed against the
property by the Contractor, or any sub-contractor, nor by any' of the material men or workmen
or any other person for any labor; or materials purchased, or extra labor or materials purchased
in connection with said work, the right toJTlc such liens being expressly waived.
