PLUMPTON, Owner Vo YINGST HOMES, INC., Contractor : IN THE COURT OF COMMON PLEAS : CUMBERLAND COUNTY, PENNSYLVANIA . WHEREAS, WILLIAM M. PLUMPTON and DEBRA L. PLUMPTON of 3606 Kent Drive, Harrisburg, Pennsylvania, is about to execute contemporaneously herewith, a contract, with Yingst Homes Inc., of 4712 Smith Street, Harrisburg, Pennsylvania, for the erection of a building upon premises commonly known as LOT 27 LISBURN MEADOWS, Township MONROE, CUMBERLAND County, Pennsylvania, as set forth in the deed dated November 9, 2001, recorded at Deed Book 249 , Page 915 , in the Recorder's Office for CUMBERLAND County, Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and attached hereto. January 8, 2002 NOW, l~btfl~_.~__vd~l~[ll[, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. PLUMPTON(J ALL that certain tract of land situate in Monroe Township, Cumberland County, Pennsylvania, and more particu!arly identified as follows: LOT NO. 27 on the Final Subdivision Plan for LISBURN MEADOWS ESTATES - NORTH, Phase II, recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 77, Page 37 et. seq., 'the metes mad bounds description for which lot is attached hereto as Exhibit "A", incorporated herein by reference and made a part hereof. UNDER AND SUBJECT, NEVERTHELESS, to the conditions, restrictions and casements as noted on the hereinabove mentioned Final Subdivision Plan; AND SUBJECT, FURTHER to the Declaration of Protective Covenants, Conditions, Restrictions and Reservations for Lisburn Meadows Estates - North dated June 15, 1998, and recorded in the Office of the Recorder of Deeds, aforesaid, in Misc. Book 582, Page 936, including but not limited to: All drainage easements and detention basins applicable to the herein described lot and detailed on' said Final Subdivision Plan.
