HomeMy WebLinkAbout02-0405 STIPULATION AGAINST LIENS THIS AGREEMENT made this /F~ day O~,~.~.002,, =-- by and between Dunning Quality Builders, a sole p~rletorship, of Carlisle, Cumberland County, Pennsylvania, hereinafter referred to as Contractor, Christopher S. Allen, hereinafter referred to as Owners, whereby the contractor undertook and agreed to install a new kitchen and bathroom at property situate in the Borough of Carlisle, Cumberland County, Commonwealth of Pennsylvania, and more fully described in Exhibit "A" which is attached hereto and made a part hereof known as 119 East High Street, Carlisle, Cumberland County, PA. NOW THEREFORE, THIS AGREEMENT WITNEs~E~.~]~!'I That Contractor, for an in consideration of the sum of ($1.00) Doll~..t~o Contractor in hand paid by Owner, the receipt whereof is hereby acknowIedged, and the further consideration mentioned in the agreemeDt iaf°resaid, for itseIf, himself or themselves and its, his or their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for itself, himself or themselves, its, his or their subcontractors and others under them, h~ereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. (SEAL Exhibit A ALL that certain tract of land with the improvements thereon erected, situate on the North side of East High Street, Carlisle Borough, Cumberland County, Pennsylvania, bounded and described as follows: BEGINNING at a point on the northern line of East High Street at the line of lands now or formerly of J.P. Karper Estate; thence in a northerly direction along lands now or formerly of the J.P. Karper Estate, 240 feet to a point on the South side of Mulberry Alley; thence in a westerly direction along Mulberry Alley 54 feet to a point on the line of lands of Lutheran Church; thence in a southerly direction along the last mentioned line, 240 feet to a point on the northern line of East High Street; thence in an easterly direction along East High Street 54 feet to the place of BEGINNING. HAVING thereon erected a 2 ~ story stone house and brick dwelling house and outbuildings known as Nos. 119 and 121 East High Street.
