MECHANICS' LIEN CLAIM
John H. Myers & Son, Inc., by and through its undersigned counsel, files the following
Mechanics' Lien Claim:
1. The Claimant is John H. Myers & Son, Inc., a Pennsylvania corporation which
has a principal place of business at 2200 Monroe Street, York, Pennsylvania 17405. Claimant
files this Claim as a Subcontractor.
2. The Owners of the real estate against which this claim is filed are William C.
Swanseen and Sandra A. Swanseen, adult individuals, who have a residence address of 18
Netherby Lane, Carlisle, Pennsylvania 17015.
3. The last day Claimant supplied material was August 4, 2011.
4. The party with whom Claimant contracted was Yanek Custom Homes, Inc., 8
South Ridge Road, Boiling Springs, Pennsylvania 17007.

5. Formal notice of Claimant's intention to file this Mechanics' Lien Claim was
given to the Owners by certified mail on January 3, 2012, and by posting the premises on
January 3. 2012. True and correct copies of the Notice of Intent to File Mechanics' Lien Claim
and the returns of service are attached and made a part hereof as Exhibit A.
6. The material supplied by Claimant was incorporated into and made a part of the
erection and construction of a residence and is fully described on the invoices attached and made
a part hereof as Exhibit B.
7. The prices charged for the material are as stated on the invoices attached as
Exhibit B. which is the amount claimed to be due of $18,196.90.
8. The real property subject to the lien is situate in South Middleton Township,
Cumberland County, Pennsylvania, known as 18 Netherby Lane, Carlisle, PA 17015, Tax Parcel
No. 40-10-0636-426, and is more fully described in the Deed dated July 1, 2011, and recorded in
the Office of the Recorder of Deeds of Cumberland County, Pennsylvania at Instrument No.
201118750, a true and correct copy of which is attached and made a part hereof as Exhibit C.

'WHEREFORE, Claimant, John H. Myers & Son, Inc., claims to have a lien upon the
premises herein described in the sum of $18,196.90.

UNDER AND SUBJECT, NEVERTHELESS, to the following building and use restrictions
which shall be binding on the lot conveyed hereunder, which building and use
restrictions the Grantees, their heirs and assigns, by acceptance of this Deed,
agree to comply:
1. No dwelling house shall be erected, placed or altered on any lot
until the proposed building and the building plans and specifications have
been approved in writing by Raymond E. Diehl and Donald E. Diehl,
(hereinafter referred to as "Owners") or their designee whom they may
appoint in writing from time to time, or their successors or assigns (any or all
of whom shall be hereafter referred to as the "Approving Party"). The
Approving Party may, upon any reasonable grounds, including but not
limited to purely aesthetic reasons, as determined by the personal
judgment of the Approving Party in its sole and unlimited discretion deny
approval of any builder or building plans. No alternations in the exterior
appearance of any dwelling house shall be made without approval of the
said Approving Party, which shall not be unreasonably withheld. One (1)
copy of all plans and specifications including the identity of the builder
shall be furnished to the Approving Party for its records. In the event that
the Approving Party fails to approve or reject in writing any builder and/or
plan submitted under this paragraph within thirty (30) days of said
submission date, which shall be noted in writing by the Approving Party on
a set of plans to be retained by the submitting party, said builder and/or
plans shall be deemed to be approved and construction may be carried
out in accordance with them, but subject, nevertheless, to all other
Protective Covenants, Reservations and Restrictions contained herein. It is
specifically noted that bi-level residences will not be approved.
1. All lots shall be used for residential purposes only, subject however to
the right of the Approving Party to allow a "home occupation" to be
conducted on the premises, as defined by and consistent with the Zoning
ordinance of South Middletown Township. No business (except said home
occupations), commercial or industrial uses whatsoever shall be permitted
on any lot.
1 No trailer, mobile home, or similar structure may be located on any
lot, temporarily or permanently, for any use whatsoever.
il. No basement, garage, vehicle or structure of a temporary character
shall be maintained or erected within said subdivision and used as a
residence or living quarters either temporarily or permanently.
5. No advertising or display sign (except and approved "home
occupation" sign as permitted by South Middleton Township) shall be
erected, placed or maintained within the said subdivision other than the
customary "For Rent" and "For Sale" signs when the same pertain to the
premises on which they are erected.
6. The construction or erection of any building or other structure must be
completed within one (1) year after the commencement thereof, except
where APPROVING PARTY grants in writing an extension of time for
completion. Sidewalks must be constructed by the lot owner as required
by South Middleton Township and as shown on Phase Number One - The
Plan for Netherby.
7. All houses constructed within Phase Number One - The Plan for
Netherby shall contain minimum living areas as follows: Two-story dwellings
-- 2,000 square feet; Cape Cod-style dwellings - 1,800 square feet; and
ranch-style dwellings - 1,700 square feet. Each house, regardless of style,
shall be built with an attached two-car garage, but the area of said
garage shall not be included in computing minimum living area hereunder.
8. Certain lots in Phase Number One -The Plan for Netherby are subject
to On-Lot Drainage Easements to facilitate continuity in storm water runoff
flows between individual building lots and detailed in the Final Subdivision
Plan of Netherby. The construction or placement of any building,
accessory building, fence or other structure and the planting of trees or
shrubbery within any such drainage easement is prohibited. The lot owner
shall be responsible for maintenance of the easement to assure that the
storm water management plan in Phase Number One - The Plan of
Netherby is not obstructed in any way.
9. Nothing shall be done within the subdivision of Netherby which may
be or become an annoyance or nuisance to the neighborhood. It shall
specifically be the responsibility of each lot owner to prevent the
development of any unclean, unsightly or unkempt conditions of buildings
or grounds on any lot which shall tend to decrease the beauty or character
of the subdivision as a whole or the particular area affected.
10. No unregistered or unlicensed vehicles of and kind shall be
maintained on the premises unless completely concealed within a garage
or other permanent structure.
11. Recreational vehicles, including but not limited to trailers or self-
propelled vehicles, or boats and/or trailers, shall not be permitted or
maintained on a permanent basis within the subdivision unless they are
parked inside a garage or other permanent structure.
12. Satellite television "dishes" shall be located in the rear yard only, and
reasonably screened from the view of neighboring properties.
13. Swimming pools shall be of the in-ground type only, located in the
rear yard only, and fenced and screened as required by South Middleton
Township.
14. No clotheslines shall be permitted anywhere on a lot. Wood piles for
fireplace or woodstove use must be in the rear area of lots.
15. No animals shall be permitted to be kept on any lot within the
subdivision except dogs, cats or other "domestic animals." No such
animals shall be commercially bred or used for commercial purposes. No
animals shall be permitted to run at large, and all animals must be house
within the dwelling house.
16. No earth shall be removed from any building lot without the prior
written consent of the APPROVING PARTY. Excess fill shall at the sole option
of the APPROVING PARTY, be deposited at such sites as shall be
determined by the APPROVING PARTY.
17. Whenever the South Middleton Township Zoning Ordinance and any
other ordinance or law regulating land use and development in South
Middleton Township are more restrictive than the within Protective
Covenants, Reservations and Restrictions, then such Zoning Ordinance and
such other ordinance or law shall take precedence.
18. The owner or its builder shall be solely responsible for obtaining any
permit necessary for any driveway to be constructed on any lot and or the
construction thereof. Driveways, as constructed, shall not obstruct the
storm water management plan as shown on Phase Number One - The Plan
for Netherby.
19. All utility lines shall be installed underground on all lots.
20. All lots shall be seeded within six (6) months of occupancy of the
residence on such lot. Owners shall maintain all trees installed by the
APPROVING PARTY.
THE BOARD OF SUPERVISORS OF SOUTH MIDDLETON TOWNSHIP HAS
DETERMINED THAT PURCHASERS OF LAND IN LIMESTONE AREAS SHOULD BE
ADVISED OF THE POTENTIAL FOR SINKHOLE DEVELOPMENT. THE ABOVE
DESCRIBED TRACT OF LAND HAS BEEN DETERMINED TO BE LOCATED IN A
LIMESTONE AREA.
BY THE ACCEPTANCE OF THIS DEED, THE GRANTEES HEREIN AGREE TO
COMPLY WITH ALL SITE GRADING REQUIREMENTS SET FORTH ON THE ABOVE
SUBDIVISION PLAN.
BY THE ACCEPTANCE OF THIS DEED, THE GRANTEES HEREIN AGREE TO
COMPLY WITH ALL ON-SITE STORM WATER MANAGEMENT.
BY THE ACCEPTANCE OF THIS DEED, THE GRANTEES HEREIN ACKNOWLEDGE
THAT SOUTH MIDDLETON TOWNSHIP SHALL NOT GRANT A CERTIFICATE OF
OCCUPANCY UNTIL SUCH TIME AS GRADING COMPLIES WITH ALL
REQUIREMENTS OF THE TOWNSHIP AND AS SET FORTH ON ABOVE
SUBDIVISION PLAN.
