THIS AGREEMENT, made the /~ay of ~"-
,2004, by and between
Pyramid Construction a Pennsylvania corporation of P.O. Box 249, Enola, PA 17025,
hereinafter referred to as "Contractor,"
Mary Louise Hanley and Edward W. Richey, 23 Houston Drive, Mechanicsburg, PA
hereinafter referred to as "Owner."
WHEREBY, contractor undertook and agreed to perform construction services to
construct a commercial building for Mary Louise Hanley and Edward W. Richey.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the Contractor, for
and in consideration of the sum of One Dollar to the Contractor in hand, paid by the
Owner, the receipt whereof is hereby acknowledged, and further consideration mentioned
in this agreement aforesaid, for itself, himself or themselves, and its, his, or their
subcontractors, and all parties acting through or under them.
COVENANT AND AGREE that no mechanic's liens or claims shall be filed or
maintained by them or any of them against the said building and the lot of ground
appurtenant thereto, for or on account of any work done or materials furnished by them or
any of them under said contract or otherwise for, towards, in or about the construction
services performed in the location above described.
AND CONTRACTOR, for itself, himself or themselves, its his or their subcontractors
and others under them, hereby expressly waives and relinquishes the right to have, file
and maintain any mechanic's liens or claims against the said buildings or any of them,
and agrees that this instrument, waiving the fight of lien, shall be an independent
covenant.

ALL THOSE CERTAIN TWO lots, pieces or parcels of land situate in the
Township of Hampden, Cumberland County, Commonwealth of Pennsylvania
being hereinafter and more particularly described together as follows,
to wit:
BEGINNING at a point on the Southern Right of Way line of Millennium
Way, said point being the common property corner of Lot #5 and Tract
#2 as shown on the Plat dated 01/28/04, thence along the southern
right-of-way line, North 59 degrees 11 minutes 43 seconds East, a
distance of 11.24 feet to an iron pin along the right-of-way of the
Millennium Way cul-de-sac, thence along an arc having a radius of 60
feet and an arc length of 65.89 feet to a point, thence along the same
arc having a 60 foot radius and an arc length of 73.79 feet to a
point, thence North 62 degrees 57 minutes 34 seconds East, a distance
of 16.35 feet to a point, thence along same North 62 degrees 57
minutes 34 seconds East a distance of 151.77 feet to an iron pin,
thence South 41 degrees 40 minutes 14 seconds East a distance of
270.00 feet to an iron pin, thence South 59 degrees 11 minutes 43
seconds West a distance of 163.04 feet to an iron pin, thence along
same South 59 degrees 11 minutes 43 seconds West a distance of 16.16
feet to an iron pin, thence North 45 degrees 26 minutes 27 seconds
West a distance of 178.80 feet to an iron pin, thence South 59 degrees
11 minutes 43 seconds West a distance of 49.15 feet to an iron pin,
thence North 30 degrees 48 minutes 17 seconds West a distance of 2
feet to a point on the southern right-of-way of Millennium Way, said
point being the point of BEGINNING.
Designated as Lot No. 6 and Tract No. 2 on a certain subdivision Plan
as recorded in the Cumberland county Recorder's Office in Plan Book
83, Page 116.
BEING the same premises which RDJAM Limited Partnership, a
Pennsylvania Limited Partnership granted and conveyed unto Mary Louis
Hanley and Edward W. Richey, wife and husband by deed dated June 15,
2004 and recorded June 16, 2004 in Cumberland County Recorder's Office
in Record Book 263, Page 2897.
