gS, Joshua T. Rhodes and Kristine L. Rhodes of 447 Nursery Drive North,
Mechanicsburg, PA 17055, is about to execute contemporaneously herewith, a contract,
with Landmark Homes of 1737 W. Main St., Ephrata, PA, for the erection of a building upon
premises commonly known as 399 Park Circle, Township of Upper Allen, Cumberland
County, Pennsylvania, as set forth in the deed dated 01/09/12, recorded at Instrument
Number 201201573, in the Recorder's Office for Cumberland County, Pennsylvania, as
more specifically described in Exhibit "A" which is incorporated herein and attached hereto.
NOW, , at the?time toff and immediately before the execution of the principal contract, and
before any authority has been given by the said Owner to the said Contractor to commence
work on the said building, or purchase materials for the same in consideration of the making
of the said contract with Contractor and the further consideration of One Dollar ($1.00), to
contractor paid by Owner, it is agreed that no lien shall be filed against the building by the
Contractor, or any subcontractor, nor by any of the materialmen or workmen or any other
person for any labor, or materials purchased, or extra labor or materials purchased for the
erection of said building, the right to file such liens being expressly waived.

ALL THAT CERTAIN Unit in the property known, named and identified in the
Declaration, referred to below, as "Winding Hills, A Planned Community,"
located in Upper Allen Township, Cumberland County, Pennsylvania, which has
heretofore been submitted to the provisions of the Pennsylvania Uniform Planned
Community Act, 68 Pa. C.S.A. §§ 5101 et seq., as amended, by the recording in
the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, the
Declaration for Winding Hills, A Planned Community ("Declaration"), dated July 26,
2005, recorded August 11, 2005, in Miscellaneous Book 719, Page 4220, and the
First Amendment to Declaration for Winding Hills, a Planned Community ("First
Amendment"), dated October 30, 2007, recorded November 7, 2007, to Instrument
No. 200742252, and designated in the First Amendment as Unit No. 85 (Unit
Identifying Number), as described in Exhibit C-1 of the First Amendment and shown
(and described) on First Amended Declaration Plats and Plans, dated October 30,
2007, recorded November 7, 2007, entered to Instrument No. 200742252.
