H 3ItI REMENT made the of February, 2012, by and between
_'EFiNSYLVAHIA
HOME DESIGNS UNLIMITED,
hereinafter referred to as Contractor,
AND
CHAD M. KIMMEL & ANDREA L. KIMMEL,
hereinafter referred to as Owner,
whereby the former undertook and agreed to erect and construct a single family
residence on that certain lot of ground known as: Lot No. 179, Indian Hills, Phase 4,
Cumberland County Plan Book 92 Page 109, to be known and numbered 212 Hope
Drive, Boiling Springs, Pennsylvania. Further described in the attached legal
description.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of One and 00/100 Dollar ($1.00) to
Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and
the further consideration mentioned in the agreement aforesaid, for themselves and
their subcontractors, and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained by them or any of them
against the said buildings and the lot of ground appurtenant thereto for or on account of
any work done or materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and construction of the said buildings
on the lot above described, and the said Contractor, for themselves, their
subcontractors and others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims against the said buildings or
any of them, and agree that this instrument,. waiving the right of lien, shall be an
independent covenant.

LEGAL DESCRIPTION
ALL that certain tract of land situate in South Middleton Township, Cumberland County, Pennsylvania, Lot
No. 179 of the Final Subdivision Plan of Indian Hills - Section No. 4, recorded in the Office of the
Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 92, Page 109, the same
being numbered as more particularly described as follows:
BEGINNING at a point on the eastern right of way line of Hope Drive (a 50 feet wide right of way) at the
dividing line of Lot No. 178 and Lot No. 179 of the aforementioned Plan; thence along the dividing line of
Lot No. 178 and Lot No. 179, North 03 degrees 04 minutes 15 seconds West 150.00 feet to a point;
thence along Lot No. 179, North 86 degrees 55 minutes 45 seconds East 102.24 feet to a point; thence
along the dividing line between Lot No. 179 and Lot No. 180, South 03 degrees 04 minutes 15 seconds
East 150.00 feet to a point; thence along the western right of way line of Hope Drive (a 50 feet wide right
of way), South 86 degrees 55 minutes 45 seconds West 102.24 feet to the point and place of
BEGINNING.
