PETITION TO COMPROMISE A MINOR'S CLAIM
AND NOW, comes the Petitioner, Daniel Barton, a minor, by and through his
undersigned attorneys, SUMMERS, MCDONNELL, HUDOCK, GUTHRIE & SKEEL, P.C. and
Thomas A. McDonnell, Esquire and sets forth the following Petition to Compromise a
Minor's Claim:
1. Penny Learner is an adult individual currently residing at 823 Erford
Road, Camp Hill, PA 17011. She is the parent and natural guardian of minor, Daniel
Barton, who was born on October 27, 1994•
2. On December 28, 2010, the minor-petitioner was injured in a motor
vehicle accident that occurred at the intersection of South 34th Street and Trindale Road
in Camp Hill Borough, Cumberland County, Pennsylvania.
3. The accident in question was due to the negligence of Steven Jackson, who
was traveling east on Trindle Road and traveled through a red light.
4. As a result of the aforementioned accident, minor-petitioner sustained a
facial laceration with scarring. (Attached hereto as Exhibit "A" is a copy of the accident
records).

5. On the date of the accident, Steven Jackson was operating a vehicle that
was insured with State Farm Mutual Automobile Insurance Company under a policy
which provided $100,ooo per person and $300,000 per accident in bodily injury
liability coverage.
6. Daniel Barton, a minor, by and through his legal guardian, Penny Learner,
has entered into a settlement agreement with State Farm Mutual Automobile Insurance
Company to accept State Farm Mutual Automobile Insurance Company's offer of $6,ooo
on behalf of the minor-petitioner as set forth more fully in the Release. (Attached hereto
and marked as Exhibit "B" is a copy of the Release executed by Penny Leamer, as Parent
and Natural Guardian of Daniel Barton).
7. The minor-petitioner's legal guardian, Penny Learner, has investigated this
matter and agrees that compensation in the amount of $6,ooo is a fair and equitable
settlement in light of the injuries sustained by the minor-petitioner. In addition, it is
hereby averred that the settlement is in the best interest of the minor-petitioner.
8. Subject to the approval of the Court, the parties have agreed to settle the
minor-petitioner's claim for $6,ooo, with the proceeds to be distributed as follows:
The sum of $6,ooo.oo shall be deposited in the name of "Daniel Barton"
in a savings account or certificate of deposit in a federally insured bank or
savings and loan association. The savings account or certificate of deposit
shall be marked `NOT TO BE REDEEMED EXCEPT FOR RENEWAL. IN
ITS ENTIRETY, IN ORDER TO BE WITHDRAWN, SIGNED,
NEGOTIATED OR OTHERWISE ALEINATED BEFORE MINOR,
DANIEL BARTON, REACHES THE AGE OF MAJORI'T'Y' on October 27,
2012, except by Order of Court of competent jurisdiction.
WHEREFORE, the Petitioners request that this IIonorable Court enter an Order
approving the Petition to Compromise Daniel Barton's minor's claim in the amount of
$6,ooo.

ON TUESDAY, DECEMBER 28, 2010, AT OR ABOUT 2052 HOURS, I WAS DISPATACHED TO A
MVA IN FRONT OF 3301 TRINDLE RD. UPON MY ARRIVAL AT THE SCENE THE ACCIDENT
TOOK PLACE IN THE INTERSECTION OF S 34TH AND TRINDLE RD. THERE WAS 1 INJURY
THAT REQUIRED TRANSPORT TO THE HOLY SPIRIT HOSPITAL. THAT VICTIM WAS DANIEL
L. BARTON, WHO SUSTAINED A CUT TO HIS FOREHEAD. THE CRASH WAS A RESULT OF
THE OPERATOR OF UNIT #2, STEVEN RAY JACKSON, WHO WAS TRAVELING EAST ON
TRINDLE RD, RUNNING A RED LIGHT.
AN INTERVIEW WAS CONDUCTED WITH BOTH OPERATORS AND THE LISTED WITNESS. THE
OPERATOR OF UNIT ##1 STATED SHE WAS TRAVELING SOUTH ON S 34TH ST AND HAD A
GREEN LIGHT. WHEN SHE WAS IN THE INTERSECTION SHE SAW HEADLIGHTS COMING FROM
HER RIGHT A14D THE NEXT THING SHE KNEW HER AIR BAG DEPLOYED AND SHE ENDED UP
STOPPING IN THE EXIT FROM THE CAMP HILL SHOPPING CENTER.

DOWN AT HIS SPEEDOMETER AND HE WAS GOING 40 IN A ZONE POSTED 40 THAT CHANGES TO
35 AFTER 34TH ST. WHEN HE LOOKED UP THE LIGHT WAS RED HE DOES NOT REMEMBER
SEEING IT YELLOW. A PASSENGER OF UNIT #2 SEATED IN THE REAR CALLED OUT TO
STEVEN THE LIGHT IS RED, THE LIGHT IS RED. THE NEXT THING I KNEW I GOT HIT IN
THE SIDE AND SPUN AROUND. MR. HOEY WAS THE PASSENGER WHO CALLED OUT.

RELEASE
For the Sole Consideration of Six Thousand Dollars and Zero Cents ($6,000.00),
the receipt and sufficiency whereof is hereby acknowledged, the undersigned hereby releases
and forever discharges Steven Jackson, his heirs, executors, administrators, agents and
assigns and all other persons, firms or corporations liable or, who might be claimed to be liable,
none of whom admit any liability to the undersigned but all expressly deny any liability, from any
and all claims, demands, damages, actions, causes of action or suits of any kind or nature
whatsoever, and particularly on account of all injuries, known and unknown, both to person and
property, which have resulted or may in the future develop from an accident which occurred on
or about the 28th day of December, 2010.
This release expressly reserves all rights of the parties released to pursue their legal
remedies, if any, against the undersigned, their heirs, executors, agents and assigns.
Undersigned hereby declares that the terms of this settlement have been completely
read and are fully understood and voluntarily accepted for the purpose of making a full and final
compromise adjustment and settlement of any and all claims, disputed or otherwise, on
account of the injuries and damages above mentioned, and for the express purpose of
precluding forever any further or additional claims arising out of the aforesaid accident.
Undersigned hereby accepts draft or drafts as final payment of the consideration set
forth above.
Any person who knowingly and with intent to defraud any insurance company or
other person files an application for insurance or a statement of claim containing any
materially false information or conceals for the purpose of misleading, information
concerning any fact material thereto commits a fraudulent insurance act, which is a
crime and subjects such person to criminal and civil penalties.

I, Penny Leamer, do hereby certify that I am the legal guardian of the minor-
Petitioner, Daniel Barton, who is presently seventeen (17) years old. I have reviewed and
discussed the proposed Settlement and Distribution set forth in the foregoing Petition
and proposed Order. The averments of the Petition are true and correct to the best of
my knowledge, information and belief. I believe that the proposed Settlement is in the
best interest of my minor son, Daniel Barton. I recommend that the Court approve the
Settlement and Order of Distribution.
I understand this Verification is made pursuant to provisions of 18 Pa.C.S.A.
Section 4904 relating to unsworn falsification to authorities.

AND NOW, this day of February, 2012, upon consideration of the

"Petition to Compromise Minor's Claim" and the "Release," attached thereto as Exhibit
B, filed by counsel for the Minor-Petitioner, Daniel Barton, and it appearing to the court
that his parent and natural guardian, Penny Leamer, concurs in the Petition, the Petition
is GRANTED to the extent as follows:
1. The Settlement between Petitioner and Steven Jackson is APPROVED,
in the total settlement amount of $6,000.00, which sum is to be paid
as follows:
a. The sum of Six Thousand dollars ($6,000.00), shall be deposited
into an interest-bearing account with a federally insured savings
and loan or banking institution of Petitioner's choosing, in the
name of "Daniel Barton";
b. The account created for Daniel Barton pursuant to this Order
shall bear the Express Restriction that there shall be no
withdrawals from the minor's account prior to the minor having
obtained the age of majority on October 27, 2012, except (i) for
payment of state or federal income taxes, or (ii) upon
subsequent Order of Court.
PETITIONER shall file, or cause to be filed, with the court proof of compliance
with this order within thirty (30) days of distribution of the settlement amount.

ORDER OF COURT
AND NOW, this Pday of February, 2012, upon consideration of the
"Petition to Compromise Minor's Claim" and the "Release," attached thereto as Exhibit
B, filed by counsel for the Minor-Petitioner, Daniel Barton, and it appearing to the court
that his parent and natural guardian, Penny Leamer, concurs in the Petition, the Petition
is GRANTED to the extent as follows:
1. The Settlement between Petitioner and Steven Jackson is APPROVED,
in the total settlement amount of $6,000.00, which sum is to be paid
as follows:
a. The sum of Six Thousand dollars ($6,000.00), shall be deposited
into an interest-bearing account with a federally insured savings
and loan or banking institution of Petitioner's choosing, in the
name of ""Daniel Barton";
b. The account created for Daniel Barton pursuant to this Order
shall bear the Express Restriction that there shall be no
withdrawals from the minor's account prior to the minor having
obtained the age of majority on October 27, 2012, except (i) for
payment of state or federal income taxes, or (ii) upon
subsequent Order of Court.
PETITIONER shall file, or cause to be filed, with the court proof of compliance
with this order within thirty (30) days of distribution of the settlement amount.
