Walker, pro se, who files this Petition for Involuntary Transfer of Motor Vehicle Title in accordance with procedures required by the Pennsylvania Department of Transportation ("PennDOT"), respectfully stating as follows: 1. Petitioner is Robert M. Walker, who appears pro se, but is also an attorney-at- law, licensed by the Commonwealth of Pennsylvania, having a residence address of 23 Irongate Court, Mechanicsburg, Cumberland County, Pennsylvania 17050. 2. On November 7, 2010, Petitioner purchased a 1966 BSA Lightning Motorcycle, VIN No. A651-15322, from Jason R. McQuown, whose address is 7527 Fishing Creek Road, Harrisburg, Dauphin County, Pennsylvania 17112. A copy of the notarized Bill of Sale from Mr. McQuown for the purchase is attached to this Petition as Exhibit "A". 3. As stated in the Bill of Sale, the motorcycle was in "rough condition", Mr. McQuown having owned the motorcycle for several years but never having had any form of vehicle title for said motorcycle. 4. On November 12, 2010, the Petitioner conducted a search of the Pennsylvania Department of Transportation records to determine if there were any active records of vehicle ownership for said motorcycle. 5. A vehicle record abstract provided by the Pennsylvania Department of Transportation, a copy of which is attached hereto as Exhibit "B", indicates that while at one time PennDOT had records relative to ownership (as evidenced by a title number), any record of ownership has been purged from PennDOT's records and there are no listed owners and no listed lien holders or title brands for the motorcycle. 6. Petitioner is in the process of restoring the motorcycle so that it may be licensed, inspected and insured for use. 7. In order to obtain a motor vehicle title for the motorcycle, Petitioner is required to commence the instance action, obtain a hearing date, and obtain an Order of Court following the hearing, in accordance with rules and regulation promulgated by PennDOT. A copy of the requirements issued by PennDOT relative to the involuntary transfer of motor vehicle titles is attached hereto as Exhibit "C". WHEREFORE, Petitioner, Robert M. Walker, respectfully requests that this Honorable Court: (i) Schedule a hearing on this Petition for consideration of Petitioner's request; and (ii) After such hearing, enter an Order of Court in the form attached as Exhibit D indicating that the Commonwealth of Pennsylvania, Department of Transportation, may accept the Order of Court as evidence of ownership in lieu of a Certificate of Title, provided Petitioner submits all forms, taxes and fees in order to receive the appropriate Certificate of Title for said motorcycle. This procedure involves obtaining a court order and should be used only in those circumstances where it is impossible to transfer ownership of a vehicle by the use of a Certificate of Title or Vehicle Manufacturer's Certificate of Origin. Since every set of facts and surrounding circumstances will be unique, a person attempting to be declared owner of a vehicle where proper ownership documents are not available should seek the advice of a private attorney. THE DEPARTMENT WILL NOT OFFER LEGAL ADVICE REGARDING THE INVOLUNTARY TRANSFER OF OWNERSHIP OF A VEHICLE. PROCEDURES A person attempting to obtain ownership of a vehicle must commence a proceeding with a court of competent jurisdiction setting forth the facts and circumstances of the case. The ownership of the vehicle will be determined by the court. Please note that a sample court order is provided on the reverse side of this fact sheet. When the above procedure is followed and the court of competent jurisdiction enters an order declaring an individual the rightful owner of the vehicle, the Department may issue a Certificate of Title to the person named in the court order upon receipt of the following: (1) A certified copy of the court order entered declaring the individual owner of the vehicle; (2) Form MV-1, "Application for Certificate of Title," and check or money order payable to the Commonwealth of Pennsylvania. (3) Appropriate sales tax, title and registration fees. Unless the petitioner is eligible to claim a Sales Tax Exemption, sales tax must be paid on the Fair Market Value of the vehicle as listed in a current edition of a Department-approved publication.
