Tiley, Esquire, Assistant Cumberland County Solicitor, and files this Petition for Rule for Judicial Sale, of which the following is a statement: 1. Your Petitioner is the County of Cumberland through its Tax Claim Bureau, a Bureau created by the Reel Estate Tax Sale Law. 72 P.S. §5860.101, et sic. 2. Pursuant to 72 P.S. §5860.610, your Petitioner respectfully represents as follows: a. Tax claim upon which the property was exposed for sale: 2009 and 2010 Cumberland County, Library and East Pennsboro Township real estate taxes. 2009-10 and 2010-11 East Pennsboro Area School District real estate taxes. Total amount of claim, including penalty, interest, and cost as of date of tax sale: $2,965.46. b. Neither the owner, his, her, their, or its heirs, successors, assigns, or legal representatives, or any lien creditor, or his, her, their or its heirs, successors or legal representatives, or any other person interested, has caused stay of : sale, discharge of tax claim or removal from tax sale. c. The property was exposed to public sale pursuant to 72 P.S. §5860.601 on: December 12, 2011. -? r-r- c Petition for Judicial Sale (Parcel No. 09-11-3008-010 Trullinger) Page 1 d. Before exposing the property to public sale the Bureau fixed the upset sale price, pursuant to 27 P.S. §5860.605, which upset price was $6,023.31. e. Your Petitioner, the Bureau, was unable to obtain a bid at the public sale sufficient to pay the said upset price. 3. Attached hereto, marked Exhibit "A," and incorporated herein by reference as is fully set forth herein, is a copy of a title report received from a title searcher retained by the Bureau together with a reduced copy of the most recent deed for the subject premises, as of the date of the search. The tax parcel number of the property is 09-11-3008-010. The property is situate in the Township of East Pennsboro, Cumberland County, Pennsylvania and is known as 725 Tower Road. 4. The names and addresses of known parties holding tax and municipal claims, liens, mortgages, ground rents, 'charges and estates against the property are as follows: a. Cumberland County Tax Claim Bureau One Courthouse Square Carlisle, Pennsylvania 17013 Delinquent taxes payable through February 29, 2012: $2,999.96 (Includes 2009, and 2010 county/municipal real estate taxes and 2009-10 and 2010-11 School areal estate taxes). b. Debbie Lupold, Tax Collector 98 S. Enola Drive, Room 101 Enola, PA 17025 2012 County and Municipal real estate taxes estimated at discount in the amount of $282.43. c. East Pennsboro Township 98 S. Enola Drive Enola, PA 17025 Taxing authority of all delinquent municipal real estate taxes collected by the Tax Claim Bureau and current taxes collected by Debbie Lupold. Respondent only admits that there was a mortgage foreclosure filed on August 17, 2011 in the Cumberland County Office of the Prothonotary as case number 2011-6490 and that counsel for the foreclosure is listed. Further responding, it is denied Wells Fargo Delaware Trust Company, NA. Trustee for Vericrest Opportunity Loan Trust 2010-NPL1 is the Plaintiff in that foreclosure action. To the contrary, a parecipe to mark the judgment to the use of Respondent, U.S. Bank Trust, N.A. as trustee for LSF6 MRO REO Trust was filed on or about February 7, 2012 in the foreclosure action. Further, the property was sold to Respondent on March 7, 2012 at the Cumberland County Sheriff s Sale. After reasonable investigation, Respondent is without sufficient information to form a belief regarding the truth of the remaining allegations contained in this paragraph, and therefore, they are denied. 5. Denied. It is denied the owner of the property is James L. Trullinger. To the contrary, Respondent purchased the property back as the mortgagee in case 2011-06490 at the March 7, 2012 Cumberland County Sheriffs Sale. Respondent is in the process of settling with the Sheriff. Moreover, Respondent is investigating the delinquent tax or municipal liens and is ready to pay the delinquent taxes and municipal liens, if any, upon settling with the Cumberland County Sheriff.
