Pennsylvania which receives service from a public sewer via a lateral line that runs from Ili,, home to the curb of the adjacent street. 4 Defendant's lateral service line was terra cota material and was sagging in the middle as a result of the-round settling and the age and quality of the material This caused sewage to back up into Defendant's residence. >. On or about August 24.20 11, Defendant. Steven R. f-11nsecker, contacted Plaintiff concerninL providing-, an estimate for labor and material to replace the damaged service line. The initial estimate was based on information provided by Defendant concerning the depth and location of the existing service line. 6. Prior to commencing work, Plaintiff camred the sewer service line to pinpoint its depth and location. It was not located where the Defendant, Steven R. Hunsecker, had represented and its depth and location entailed a more difficult job. 7. Plaintiff explained to Defendant. Steven R. 1-lunsecker. that the difficulty and scope ofthc job was more complicated and that the original estimate was void. COUNT 1 - BREACH OF CONTRACT SPEEDY ROOTER, INC. VS. STEVEN R. HUNSECKER 8. The allegations of clause I through 7 are incorporated herein by reference. 9. After having the difficulty of the work explained to him, Defendant, Steven R. Hunsecker, verbally authorized Plaintiff to complete the work on a time and material basis. 10. The work completed by Plaintiff was completed in a workmanlike manner. The charges for labor and materials were fair and reasonable for the area. Plaintiffs bill for the work completed was 57.175.00 and was sinned by Defendant, Steveii R. Hunsecker, on October 6,201 1. The bill provided for a 1.5°'o per month charge on invoices over 30 days. A copy of this bill is attached hereto, labeled as Exhibit -'A", and is incorporated herein by reference. WHEREFORE, Plaintiff respectfully asks Your Honorable Court to award damaoes of $7.175.00 Plus 1.51)o per month thereafter plus costs. COUNT 11 - UNJUST ENRICHMENT SPEEDY ROOTER, INC. VS. STEVEN R.
