ON- NyY? cui l a V. CIVIL ACTION - LAW INFRASTRUCTURE TECHNOLOGY CONTRACTORS, INC., Defendant COMPLAINT 1. The Plaintiff, Insurance & Surety, Inc., is a Pennsylvania corporation with a place of business at 3045 Market Street, Camp Hill, Cumberland County, Pennsylvania 17011. 2. The Defendant, Infrastructure Technology Contractors, Inc., is a Pennsylvania corporation with a place of business at 910 North Second Street, Harrisburg, Dauphin County, Pennsylvania 17012. 3. Pursuant to a written application from Defendant, Plaintiff sold and provided various products of commercial insurance for Defendant including but not limited to automobile, workers' compensation and an umbrella policy. 4. The Defendant paid its monthly invoices through to approximately March of 2002, at which point it began to accumulate an arrears on the balance due to Plaintiff for its insurance premiums. 5. The Plaintiff has fully performed its obligations by providing the insurance coverage requested and approved by Defendant. 6. Defendant is in breach of the aforesaid agreement in that it has failed to pay the premiums due to Plaintiff on a timely basis. 7. The aforesaid insurance policies issued to Defendant were cancelled by Plaintiff on or about August 1, 2004 and September 30, 2004 for nonpayment of the premiums. 8. After crediting, all payments received to date by Plaintiff, including the last payment made by Defendant on January 13, 2003 in the amount of $4,304.00, there is justly due and owing from Defendant to Plaintiff the sum of $21,129.00 as of August 31, 2004. 9. Plaintiff has demanded payment of the outstanding balance from Defendant but Defendant has refused and neglected and still refuses and neglects to pay the same or any part thereof. 10. Attached hereto as Exhibit "A" and made a part hereof is a Statement of Account as of August 31, 2004 showing the amounts due and the coverages provided to Defendant by Plaintiff. WHEREFORE, Plaintiff demands judgment in the amount of $21,129.00 plus interest at the rate of six (6%) percent per annum on this amount plus costs, which total is less than the amount for compulsory arbitration in this County.
