STIPULATION AGAINST LIENS
WHEREAS, Michael A. Wichrowski and Michelle L. Sommer, husband and wife,
of Pennsylvania, is about to execute contemporaneously herewith, a contract with Sheely Homes,
Inc., a Pennsylvania Corporation of Cumberland County, Pennsylvania, for the erection of a
dwelling upon a lot of land situate as follows:
ALL THAT CERTAIN tract or parcel of land being situated in Silver Spring
Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a point located on the western right-of-way line of Millfording Road
(T-700, a 50 foot right-of-way) at the northeast corner of Lot No. 61 on the hereinafter referenced
Plan; thence along the northern boundary line of Lot No. 61, North 43 degrees 08 minutes 43
seconds West, a distance of 88.30 feet to a point; thence continuing along the same, North 82 degrees
48 minutes 43 seconds West, a distance of 314.91 feet to a point along the Condoguinet Creek;
thence along said creek, North 18 degrees 28 minutes 17 seconds East, a distance of 55.02 feet to
a point; thence continuing along the same, North 07 degrees 11 minutes 17 seconds East, a distance
of 23.02 feet to a point at the southwest corner of Lot No. 63 on. the hereinafter referenced Plan;
thence along the southern line of Lot No. 63, South 82 degrees 48 minutes 43 seconds East, a
distance of 367.97 feet to a point; thence continuing along the same, South 43 degrees 08 minutes
43 seconds East, a distance of 88.21 feet to a point on the western right-of-way line of Millfording

Road; thence along Millfording Road, South 46 degrees 51 minutes 17 seconds West, a distance of
93.43 feet to a point; thence continuing along the same, by a curve to the left having a radius of
225.00 feet and an arc length of 6.58 feet to a point, the Point and Place of BEGINNING.
BEING Lot No. 62 on the Final Subdivision Plan of Millfording Highlands, Phase
II, recorded September 3, 2009 in the Cumberland County Recorder of Deeds Office in Instrument
No.: 200931000.
CONTAINING 34,980.16 square feet or 0.8030 acres.
ALSO BEING that certain Unit, being Unit No. 62 (the "Unit") of Millfording
Highlands, a Planned Community, which Unit is designated in the Declaration of Covenants and
Restrictions for Millfording Highlands, a Planned Community (the "Declaration") and Declaration
Plats and Plans recorded as an exhibit thereto in the Office of the Recorder of Deeds of Cumberland
County, Pennsylvania to Instrument No.: 200730960, together with any and all amendments thereto.
TOGETHER with the undivided Allocated Interest appurtenant to the above
referenced Units as more particularly set forth in the aforesaid Declaration, as last amended.
NOW, the avy day of March, 2012, at the time of and immediately before the
execution of the principal contract, and before any authority has been given by the said Michael A.
Wichrowski and Michelle L. Sommer, husband and wife to the said Sheely Homes, Inc., a
Pennsylvania Corporation to commence work on the said building, or purchase materials for the
same in consideration of the making of the said contract with Sheely Homes, Inc., a Pennsylvania
Corporation and the further consideration of One Dollar, to Sheely Homes, Inc,,, a Pennsylvania
Corporation paid by Michael A. Wichrowski and Michelle L. Sommer, husband and wife it is agreed
that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of
the material men or workmen or any other person for any labor, or materials purchased, or extra
labor or materials purchased for the erection of said building, the right to file such liens being
expressly waived.
