Plaintiff, CITIBANK, N.A. claims as follows:
1. The Defendant(s), JESSICA DALINSKY, is a resident of Cumberland County,
Pennsylvania.
2. Defendant opened a credit account with Plaintiff on or about July 14, 2005.
3. Defendant used the account to make purchases and charges and/or receive cash advances.
4. Plaintiff billed the Defendant for payment of charges on the account and Defenant has
assented to the account.
5. Defendant has failed to make payment for the amounts due and owing.
6. There currently remains a balance of $7392.86.
7. An account stated for the sum of $7392.86 exists which sum reflects the Exhibit A statement
balance less'credits, if any, which were applied subsequent to the date of Exhibit A.
8. Defendant last made a payment on the account on 08-06-2010 .

Before me, the undersigned authority, personally appeared the person identified below, who being by me duly sworn,
deposed as follows:
1. My name is DWM J. Rsha I am of sound mind, lawful age and capable of making this Affidavit.
The statements set forth in this affidavit are true and correct based on personal knowledge and review of the business records
described herein. I am authorized to make this affidavit on behalf of Citibank, N.A. (referred to herein as "Citibank"). This includes
accounts previously owned by Citibank (South Dakota), N.A., which merged into Citibank in or about July 2011.
2. 1 am employed by Citicorp Credit Services, Inc. (USA) (referred to herein as "CCSI"). CCSI is a subsidiary of Citibank and services
accounts owned by Citibank, including maintaining and recording information in Citibank's records. Citibank Is a National Bank
with its home office in Sioux Falls, South Dakota.
3. My employment duties include being a custodian of records for CCSI and Citibank with respect to accounts owned by Citibank. As
a custodian of records, I have knowledge of, and access to, account information and records concerning the defendant's Citibank
account number currently ending in 3895, which is the subject of this lawsuit (the "Account").
4. Citibank's records regarding the Account contain the name and billing address of the defendant, the Account number (and
predecessor account numbers, if any), the Account's history, including charges made, interest and/or fees assessed, payments
and/or credits received, and the minimum payment due and the total outstanding balance due on the Account, all of which are
collectively referred to as the "Account Information."
5. Citibank and CCSI maintain records and the Account Information in the ordinary course of business, which is made at or near the
time of each event recorded by someone with personal knowledge of the events, or from information transmitted by someone with
personal knowledge of each event, and a business duty to record such information.
6. The Account Information reflects that charges were made on the Account to purchase goods and services and/or obtain cash
advances. Defendant was provided periodic billing statements for the Account when there was Account activity, which described
the charges on the Account, along with interest, fees, payments, credits and the amount due on the Account. Attached hereto and
incorporated herein as Exhibit A are true and correct copies of the Account statement transaction detail for the period from
2/16/2011 to 3/15/2011 that was sent to the defendant (the "Account Statement").
7. The Account Information shows that the Account Statement was sent to the defendant either by regular mail or by electronic mail.
The attached Account Statement does not reflect any outstanding disputes on the Account.
8. As reflected in the Account Information, defendant did eventually fail to make required payments on the Account.
9. As a result of defendant's failure to make proper payments on the Account, defendant is presently in default on the Account.
10. As reflected on the attached Account Statement, the balance on the Account is $7,392.86. After the attached Account Statement
was sent to the defendant, an additional payment or credlt/debit was received on the Account in the amount of $0.00. As of the
date of this affidavit, the Account balance of $7,392.86 is due and owing.
11. The debt reflected herein is delinquent, past due and remains due and owing. Citibank is the owner of the Account and the party
and entity to whom the delinquent debt is owed.

Representations in support of her Preliminary Objections in this instant matter:
1. The above named Defendant alleges and avers the Plaintiff in the instant
Matter Filed on March 5, 2012, a civil complaint in the Court of Common Pleas
of Cumberland County.
2. The above named Defendant alleges and avers the subject matter of the
complaint is a credit card account alleged opened by the Defendant through the

1. FACTUAL BACKGROUND
The above named Defendant has been sued by the above named Plaintiff in Regards to a credit card
allegedly issued by Citibank, N.A., to the Defendant in this Matter. The Plaintiff has attached to its
complaint "Statement of Account" that fails to contain any material facts and/or sufficient information
so that the Defendant can determine the basis of the alleged balance owed and constitutes insufficient
specificity in a pleading under Pa. R.C.P.1028(a)(3). The Plaintiff also failed to attach any documents
with the Defendant's signature showing an agreement between the Defendant and the Plaintiff in the
instant matter. Furthermore, the Plaintiff failed to attach any decree of assignment in the instant
matter.
2. LEGAL ARGUMENT
HAS THE PLAINTIFF MET THE LEGAL SUFFICIENCY NECESSARY FOR THE COMPLAINT IN THE INSTANT
MATTER?
REPLY: In the Negative
The instant action is clearly a credit card action brought by Citibank, N.A. The Plaintiff has filed in this
instant matter and attached one exhibit to the complaint. Exhibit "A" shows a "Statement of Account"
with the name of Citi Cards. The "Statement of Account" fails to contain any material fads and/or
sufficient information so that the Defendant can determine the basis of the alleged balance owed and
constitutes insufficient specificity in a pleading under Pa. R.C.P.1028(a)(3). The Plaintiff also failed to
attach any documents with the Defendant's signature showing an agreement between the Defendant
and the Plaintiff in the instant matter. Furthermore, the Plaintiff failed to attach any decree of
assignment in the instant matter.
The Pennsylvania Rules of Civil Procedure require that when a claim is being made as in this case for
credit card balances and that the claim is based upon a writing, the pleader, the Plaintiff in this instant
action, shall attach a copy of the writing or the material part thereof to the complaint. (See Rule
1019(i), Pa. Rules of Civil Procedure)
In the instant matter the Plaintiff has not attached any contract, nor any writing, nor any material part
of any writing to the complaint in this case. The preliminary objections assert that Pa. R.C.P. No. 1019
requires plaintiff to allege and/or attach documentation which contains the charges that are part of
the claim, the dates of the charges, credits for payments, amounts of interest charges, and amounts of
other charges.
What the Plaintiff has attached is a "Statement of Account" that clearly is inappropriate and should be
stricken, because it fails to contain any material facts and/or sufficient information so that the
Defendant can determine the basis of the alleged balance owed and constitutes insufficient specificity
in a pleading under Pa. R.C.P.1028(a)(3).
When dealing in a contract matter the most fundamental requirement of that pleading would be a
copy of the contract. As indicated above under Rule 1019, it is required to be attached or some
material part thereof. Having not attached it therefore the pleading in this matter clearly does not
meet the sufficiency as is necessary in this case. There are no other actions that have been taken by
the Plaintiff which could have cured this matter.
3. CONCLUSION
In a contract action the contract is required to be part of the complaint. In this action although a credit
card collection action is based on a contract, the contract has not been attached. Both the law of the
Commonwealth of Pennsylvania and the Pennsylvania Rules of Civil Procedure require the contract
signed by all the parties be attached. Failure to have the contract attached is a fatal error and
therefore the case must be dismissed.

Defendant, Jessica Dalinsky, denies the following numbered statements of Plaintiffs Complaint:
1. Defendant denies the allegations contained in the Exhibit "A" in the Complaint as Defendant is
without sufficient knowledge or information to form an opinion as to the truth and accuracy of
alleged assignments and entitlements.
2. Defendant denies the allegations contained in Statement 2 as there is not, nor has there ever
been any written agreement implied with the Plaintiff and Defendant.
3. Defendant lacks knowledge about the truth and therefore denies allegations contained in
Statements 2, 3, 4, 5, 6, 7, and 8.
4. The Plaintiff failed to state a claim upon which relief can be granted
5. Defendant was not notified of any assignment of the debt that is the subject of the Complaint.
6. Defendant claims Lack of Privity as Defendant has never entered any contractual or
debtor/creditor arrangements with Plaintiff.
7. Plaintiffs Complaint fails to allege a valid assignment of debt and there are not averments as to
the nature of the purported assignment or evidence of valuable considerations; Plaintiffs
Complaint fails to allege whether or not the purported assignment was partial or complete and
there is no evidence that the purported assignment was bona fide.
8. Plaintiffs Complaint further fails to allege that the Assignor even has knowledge of this action or
that the Assignor conveyed all rights and control to the Plaintiff. The record does not disclose
this information and it cannot be assumed without creating an unfair prejudice against the
Defendant.
9. The Plaintiff has not proven they are authorized and licensed to collect claims for others in the
State of Pennsylvania, solicit the right to collect or receive payment of a claim of another
10. Plaintiff is barred under the Fair Debt Collection Practices Act, hereinafter called FDCPA, Section
807(2), 15 U.S.C.1692e(2) from collecting interest and any amount unless it is expressly
authorized by the agreement creating the alleged debt or permitted by law. Plaintiff has failed
to attach proper documentation to verify if such interest is allowed.
11. Plaintiffs damages are limited to real or actual damages of actual cost paid or exchanged to
alleged Original Creditor for the purported debt.
12. Defendant reserves the right to plead other affirmative defenses that may become applicable
and/or available at a later time.

Plaintiff, Citibank, N.A., by and through its attorneys, Blatt Hasenmiller, Leibsker and
Moore. LLC, does aver as follows:
l . "l~he Plaintiff herein is Citibank, N.A., which has retained tlhe services of
Blatt, Hasenmiller, Leibsker and Moore, LLC, located at 1835 Market Street, Suite
~Ol, Philadelphia, PA 19103.
2. Defendant is Jessica Dalinsky, whose last known principal address is 113 Pearl Dr,
Carlisle, PA 17013.
3. Defendant requested and. was given a credit card, :for the account now ending in
x895, which originated on or about July 14, 2005.
4. fhe card agreement, which is the writing upon which this case is based, is attached
and marked as Exhibit A, which Plaintiff intends to use at Arbitration in accordance
~~ith Pa.RC.P. 1305.
S. Defendant continued to use the credit and make payments as evidenced Ley the
statements attached and incorporated herein as~ Exhibit B, which plaintiff intends to
use at Arbitration in accordance with Pa.R.C.F'. 1305.
6. Defendant's assent is indicated by the charges and payments on the said statements.
7. Defendant .last made a payment, on or about August 6, 2010.
8. 7,he charge off date for the account is March 15, 201 I .
9. Defendant has a balance of $7,392.86 (exclusi.ve of court costs) and has failed to
make payments upon that account as defendarrt had agreed to do (Attached and
incorporated herein as Exhibit C is an Affidavit of debt, substantiating the said
amount due).
WHEREFORE, Plaintiff requests Judgment in the amount of $7,392.86, plus court costs
and interest from the date of the Judgment.

Before me, the undersigned authority, personally appeared the person identified below, ~aho being by me duly sworn,
deposed as follows:
Jessica Lamle
1. My name is I am of sound mind, lawful age and capable of making this Affidavit. The statements
set forth in this affidavit are true and correct based on my personal knowledge and review of the business records described herein. I
am authorized to make this affidavit on behalf of plaintiff Citibank, N.A. (referred to herein as "Citibank'). Citibank is a National Bank
located in Sioux Falls, South Dakota.
2. I am employed by Citibank or an affiliate. My job title is Document Control Officer. My employment duties include being a custodian of
records with respect to accounts owned by Citibank. As a custodian of records, I have knowledge of, and access to, account
information and records concerning the defendant's Citibank account number currently ending in 3895, which is the subject of this
lawsuit (the "Account"). As a result, I am competent to testify to the matters stated herein.
3. Citibank's records regarding the Account contain the name and billing address of the defendant, the Account number (and
predecessor account numbers, if any}, the Account's history, which may include charges made, interest and/or fees assessed,
payments and/or credits received, and the minimum payment due and the total outstanding balance due on the Account, all of which
are collectively referred to as the "Account Information". Exhibit A attached hereto and incorporated herein are copies of the Account
statement transaction detail for the period from 3/16/2010 to 3/15/2011 that was sent to the defendant (the "Account Statement").
4. The Account Information reflects that charges were made on the Account to purchase goods and services and/or obtain cash
advances. Defendant was provided periodic billing statements for the Account when there wes Account activity, which described the
charges on the Account, along with interest, fees, payments, credits and the amount due on the Account.
The Account is subject to written terms and conditions, as amended from time to time, which are reflected in the exemplar card
agreement attached as Exhibit B along with the Account Statements, Defendant agreed to the farms and conditions by using the
Account.
5. Exhibit(s) A and 13 are business records reflecting information created and maintained by Citibank or its affiliates, in the course of
regularly conducted business activity, and are part of the regular practice of Citibank to create and maintain such information, and
also were made at the time of the act, transaction, occurrence or event ar within a reasonable time thereafter.
6. As reflected in the Account Information, defendant did eventually fail to make required payments on the Account.
7. As a result of defendant's failure to make proper payments on the Account, defendant is presently in default on the Account.
8. The Account Information shows that the Account Statement reciting the amount of the debt was sent to the defendant either by
regular mail or by electronic mail. The attached Account Statement does not reflect any outstanding disputes on the Account.
9. As reflected on the attached Account Statement, the balance on the Account is $7,392.86. After the attached Account Statement was
sent to the defendant, an additional payment or crediUdebit was received on the Account in the amount of $0.00..As of the date of
this affidavit, the Account balance of $7,392.86 is due and owing,
10. Citibank's records reflect that defendant opened and/or used the Account and, therefore, to the best of my knowledge, defendant is
neither an incompetent, nor a minor.
11. The debt reflected herein is delinquent, past due and remains due and owing. Citibank is the owner of the Account and the party and
entity to whom the delinquent debt is owed.

The Defense Manpower Data Center(DMDC)is an organization of the Department of Defense(DoD)that maintains the Defense Enrollment and Eligibility
Reporting System(DEERS)database which is the official source of data on eligibility for military medical care and other eligibility systems.
The DoD strongly supports the enforcement of the Servicemembers Civil Relief Act(50 USC App.§501 at seq,as amended)(SCRA)(formerly known as
the Soldiers'and Sailors'Civil Relief Act of 1940). DMDC has issued hundreds of thousands of"does not possess any information indicating that the
individual is currently on active duty"responses,and has experienced only a small error rate. In the event the individual referenced above,or any family
member,friend,or representative asserts in any manner that the individual was on active duty for the active duty status date,or is otherwise entitled to the
protections of the SCRA,you are strongly encouraged to obtain further verification of the person's status by contacting that person's Service via the

President and supported by Federal funds. All Active Guard Reserve(AGR)members must be assigned against an authorized mobilization position in the

Coverage under the SCRA is broader in some cases and includes some categories of persons on active duty for purposes of the SCRA who would not be
reported as on Active Duty under this certificate. SCRA protections are for Title 10 and Title 14 active duty records for all the Uniformed Services periods.
Title 32 periods of Active Duty are not covered by SCRA,as defined in accordance with 10 USC§101(d)(1).
Many times orders are amended to extend the period of active duty,which would extend SCRA protections.Persons seeking to rely on this website
certification should check to make sure the orders on which SCRA protections are based have not been amended to extend the inclusive dates of service.
Furthermore,some protections of the SCRA may extend to persons who have received orders to report for active duty or to be inducted,but who have not
