Salzmann Hughes, P.C. and files this claim of mechanics' lien against Rine Land Development, Inc.
("Defendant") pursuant to the Mechanics' Lien Law of 1963, as amended, against the improvements
and the estate or title of the owner, for the payment of all debts due Claimant as a contractor for
erection and construction, labor and materials furnished for the improvement known as Southwood
Crossing, Phase I, located in Southampton Township, Cumberland County, Pennsylvania, herein
described, upon the following statements:
1. The Claimant is David H. Martin Excavating, Inc., a Pennsylvania corporation, having its
principal office at 4961 Cumberland Highway, Chambersburg, Pennsylvania 17202.
2. The owner or reputed owner of the leasehold, property and improvements against whom
the claim is filed is Rine Land Development, Inc. having its principal office at 19 Independence
Drive, Shippensburg, Pennsylvania 17257 (the "Owner").
3. Claimant makes this claim as a contractor in accordance with a contract by and between
Claimant and Rine & Rine Builders, Inc whereby Claimant provided certain labor and materials

related to the grading, paving, curbing, sanitary sewer and water lines, storm sewer inlets and roof
drains. A copy of the contract is attached hereto and incorporated herein as Exhibit A.
4. Invoices which describe the labor and materials supplied by Claimant and the time of
performance or delivery as well as the itemized cost thereof are attached hereto and incorporated
herein as "Exhibit B".
5. Claimant completed the erection and construction as provided in the contract for
Southwood Crossing - Phase I that is the subject of this claim on November 15, 2011.
6. The total amount claimed to be due and owing is One Hundred Forty Nine Thousand,
Seventy Dollars and Sixty Six Cents ($149,070.66) for work performed.
7. The real estate subject to the lien is located in Southampton Township, Cumberland
County, Pennsylvania, and is comprised of the following parcels:

8. The labor and materials furnished by Claimant for the erection and construction of
improvements benefited the property owned by Defendant and described herein.
9. Notice of intent to file claim was served on the owner by first class certified mail, postage
prepaid, which notice and sender's receipt is attached hereto and incorporated herein as Exhibit C.
WHEREFORE, Claimant files this claim for mechanics' lien in the amount of $149,070.66,
with interest as provided by law.

Water laterals and sanitary sewer laterals will be extended to 5' beyond the right-of-way
line and marked with a 2 x 4
David H. Martin Excavating, Inc. is responsible for grading the stone under the paving
one time. If other contractors working on the site disturb the stone in a manner that
compromises the integrity of the work we will not be responsible for the cost to repair
the area(s) to its previous state.
The quoted prices in this proposal can be held for a period of 30 days from the date of
this proposal. Due to the volatility of material prices, after 30 days, the prices are subject
to material cost and subcontractor price inflation.
Paving prices are subject to liquid asphalt price escalation; If the paving price increases
from the time of our proposal to the time of installation the owner/developer will be
issued a change order and the owner/developer will be billed accordingly ($410.00 is
current liquid asphalt index)
Starting this project is contingent on DHM, Inc. being provided with a set of
approved/stamped plans from the Cumberland County Conservation District and the
NPDES Permit being in the current owner's name so DHK Inc. can sign on as a Co-
Permittee as required by the law.
As a part of another agreement a sanitary sewer lateral will need to be extended to the
existing Martin property adjacent to Airport Road. Rine & Rine Builders, Inc. and The
Willow Group will have David H. Martin Excavating, Inc. complete this work on a time
and material basis and the cost will be distributed to both Rine & Rine Builders, Inc. and

As part of this agreement any rock encountered on the off site sewer portion of this
project at or above the original sanitary sewer pipe invert depth will be distributed to
both Rine & Rine Builders, Inc. and The Willow Group at the same cost ratio that is set
forth in the "Southwood and Pieper Road Expenses" attachment that is at the back of
this proposal. The Willow Group will solely assume the cost for removing the rock
below the aforementioned original sanitary sewer pipe invert depth.
Also as part of this agreement any rock encountered on the onsite sanitary sewer trunk
line that will later serve as part of the sewer line that will eliminate an offsite pumping
station will be distributed to both Rine & Rine Builders, Inc. and The Willow Group at
the same cost ratio that is set forth in the "Southwood and Pieper Road Expenses"
attachment that is at the back of this proposal. Additionally this same ratio will be
utilized in the future if and when the sanitary sewer line is extended across the other
phases of Southwood Crossing as well as across the adjacent properties to the Fields
project site.
The property disturbed on the Southwood Crossing site as a result of the sewer main
installation to the property owned on Pieper Road by The Willow Group, LLC. will be
restored to its previous condition after David H. Martin Excavating, Inc. has completed
its excavating procedures on the Southwood Crossing site.

Contract Agreement
Execution of this document on this day of 2009 as indicated by the
signatures below exhibits acceptance of the terms and scope of work and is an
agreement between the Contractor; David H. Martin Excavating, Incorporated having a
business address at 4961 Cumberland Highway, Chambersburg, PA
and the Owner;

It is agreed that the Contractor will perform the above scope of work for the stated
prices and the Owner will pay the Contractor monthly payments equal to the portion of
work completed during the 30 days preceding the 20th of each month there is work
performed. Invoices will be billed in AIA format on the 20th or shortly thereafter for
each month or portion of a month there is work performed. Payments for the invoiced
work will be paid by the Owner within 15 days of the date of the invoice,.
Any changes to the above scope of work must be in a change order format and signed
by the Owner or his authorized representative and an official or authorized
representative of David H. Martin Excavating, Incorporated prior to performing the
changed work.

You are hereby notified that David H. Martin Excavating, Inc. is a contractor
under a contractual arrangement with Rine & Rine Builders, Inc. and has furnished labor
and/or materials in connection with the grading, paving , curbing, sanitary sewer and
water lines , storm sewer inlets and roof drains to property owned by you which is

The labor and/or materials furnished by the contractor consisted of labor, equipment and
materials related to the grading, paving, curbing, sanitary sewer and water lines, storm
sewer inlets and roof drains. A copy of the contract for said work is attached hereto as
Exhibit A. Invoices which describe the labor and materials supplied is attached hereto
and incorporated herein as Exhibit B. David H. Martin Excavating, Inc. completed the
furnishing of labor, equipment and materials on or about November 15, 2011. The
amount still due and payable to the contractor for completed work is One Hundred Forty-
Nine Thousand, Seventy Dollars and Sixty Cents ($149,070.66).
Unless payment of the amount due is made within thirty (30) days after service of this
formal notice on you, the contractor intends to file a mechanics' lien claim for this
amount against your property. The filing of the claim will result in a lien against your
property, and proceedings to enforce the lien may result in a judgment against you and
the forced sale of your property.
