CIVIL ACTION - COMPLAINT IN BREACH OF CONTRACT
And now comes Susquehanna Bank successor by merger to Community Banks, Plaintiff,
by its attorneys, James, Smith, Dietterick & Connelly LLP, and files this Complaint in Breach of
Contract as follows:
The Plaintiff is Susquehanna Bank successor by merger to Community Banks,
which has its principal place of business P.O. Box 639, Maugansville, Maryland 21767.
2. The Defendants, Jon B. Liddick and Patricia A. Liddick, are adult individuals who
reside at 137 E. Penn Street, Carlisle, Pennsylvania 17013.
3. On or about March 18, 2005, Defendants executed a Fixed Rate Consumer Note
("Note") in favor of Plaintiff in the original principal amount of $34,700.00. A true and correct
copy of said Note is marked Exhibit "A", attached hereto and made a part hereof.
4. Under the terms of the aforesaid Note, Plaintiff is entitled to accelerate payment
of the principal balance, accrued and unpaid interest and all other sums due and owing
under the terms of the Note upon the occurrence of an event of default, including but not limited
to, the failure to pay monthly installments of principal and interest when due.
5. The aforesaid Note has not been released, transferred or assigned by Plaintiff.
6. Defendants have breached their duty imposed by the aforesaid Note and are in
default under the terms of the said Note for, inter alia, failing to make monthly installments of
principal and interest when due.
7. Any and all conditions precedent to payment to Plaintiff have been satisfied.
8. Notwithstanding Plaintiffs demands for payment, Defendants' obligations under
the terms of the aforementioned Note remain unsatisfied.
9. The amount due and owing Plaintiff by Defendants is as follows:
Principal $ 23,462.58
Interest through 3-6-2012 $ 583.32
Late Charges $ 80.00
Satisfaction Fee $ 40.00
Appraisal Fee $ 275.00
Attorneys' Fee & Costs $ 2,444.09
(10% of Total Due)
TOTAL $ 26,884.99
plus interest on the principal sum ($23,462.58) from March 6, 2012, at the contractual rate of
$4.16 per diem, plus additional late charges, and costs.
WHEREFORE, Plaintiff demands judgment in its favor and against Defendants for the
total amount due of $26,884.99, with interest on the principal sum ($23,462.58) from March 6,
2012, at the rate of $4.16 per diem, plus additional late charges, attorneys' fees and costs.

bailiwick. He therefore deputized the Sheriff of Perry County, Pennsylvania to serve the within Complaint
and Notice according to law.

and inquiry for the within named defendant, to wit: Patricia A. Liddick, but was unable to locate her in hi
