HANCOCK, an adult individual, of Cumberland County, Pennsylvania, Owner, is about to contemporaneously herewith execute a contract with KBG ASSOCIATES, L.L.C., a Pennsylvania Limited Liability Corporation, Contractor, with a principal place of business located at 518 Bridge Street, New Cumberland, Cumberland County, Pennsylvania 17070, for the erection/renovations upon a certain lot of land situate and known as Lot No. 17, Redwood Hills, Plan Book 55,Page 128 (Tax Parcel #21-09-0535-014), Middlesex Township, Cumberland County, Pennsylvania, and which is more particularly described on Exhibit "A," attached hereto and made a part hereof. NOW, this 28th day of January, 2002, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor, to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with the Contractor and the further consideration of One ($1.00) Dollar and other valuable considerations, receipt of which is hereby acknowledged, to the Contractor paid by the Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any sub-Contractor nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection/renovations to said building, the right to file such liens being expressly waived. Garman, Authorized Officer ALL THAT CERTAIN parcel of land situate in Middlesex Township, Cumberland County, Pennsylvania, and shown as Lot No. 17 in the Redwood Hill Subdivision Plan dated January 12, 1988 and recorded in the Office of the Recorder of Deeds of Cumberland County in Miscellaneous Book 55, at Page 128, more fully bounded and described as follows, to wit: BEGINNING at a point being the southwest comer of lot no. 18 on the aforesaid subdivision plan; thence north fifty-four (54) degrees, fifty-five (55) minutes, seventeen (17) seconds east a distance of two hundred twenty-one and eighty one-hundredths (221.80) feet along the southern line of lot no. 18 on the aforesaid subdivision; thence south forty-four (44) degrees, fifty-seven (57) minutes, sixteen (16) seconds west a distance of one hundred twenty-five and ninety-one one-hundredths (125.91) feet to a point; thence along the curve of Redwood Drive three hundred thirty-six and sixty-seven one-hundredths (336.67) feet and Arc distance of eighty-four and thirty-one one-hundredths (84.31) feet to a point; thence south forty-five (45) degrees, forty-six (46) minutes, thirty-eight (38) seconds west a distance of two hundred eighty-three and forty-two one-hundredths (283.42) feet along the north line of lot no. 16 on the aforesaid subdivision plan to a point; thence along the curve of Hickorytown Road (TR-512) a radius of seven hundred fifty-three and forty-three one-hundredths (753.43) feet an Arc distance of one hundred thirty-three and twenty-six one-hundredths (133.26) feet to a point; thence north thirty-five (35) degrees, four (04) minutes, thirty-two (32) seconds west a distance of one hundred sixteen and ninety-one one- hundredths (116.91) feet to a point, the place of BEGINNING. UNDER AND SUBJECT to all right-of-ways, streets and easements of record. CONTAINING 1.275 acres, more or less. BEING A PART OF THE SAME PREMISES WHICH Northern Construction Associates, a Pennsylvania Partnership made up of Harry L. Grossman and Michael E. Garman, by its Deed dated January 11, 2002 and recorded January 14, 2002 in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania at Deed Book 250, Page 0004, transferred and conveyed unto Frank R.
