3. On 02/13/2003 CHAD S. RHOADES made, executed and delivered a mortgage upon the
premises hereinafter described to AMERICA'S WHOLESALE LENDER which
mortgage is recorded in the Office of the Recorder of CUMBERLAND County, in
Mortgage Book 1798, Page 3552. The PLAINTIFF is now the mortgagee and is in the
process of formalizing an assignment of same. The mortgage and assignment(s), if any,
are matters of public record and are incorporated herein by reference in accordance with
Pa.R.C.P. 1019(g); which Rule relieves the Plaintiff from its obligations to attach
documents to pleadings if those documents are of public record.
4. The premises subject to said mortgage is described as attached.
5. The mortgage is in default because monthly payments of principal and interest upon said
mortgage due 06/01/2011 and each month thereafter are due and unpaid, and by the terms
of said mortgage, upon failure of mortgagor to make such payments after a date specified
by written notice sent to Mortgagor, the entire principal balance and all interest due
thereon are collectible forthwith.

Plaintiff is not seeking a judgment of personal liability (or an in person am judgment)
against the Defendant(s) in the Action; however, Plaintiff reserves its right to bring a
separate Action to establish that right, if such right exists. If Defendant(s) has/have
received a discharge of personal liability in a bankruptcy proceeding, this Action of
Mortgage Foreclosure is in no way an attempt to reestablish such personal liability
discharged in bankruptcy, but only to foreclose the mortgage and sell the mortgaged
premises pursuant to Pennsylvania Law.
Notice of Intention to Foreclose as set forth in Act 6 of 1974 and/or Notice of Default as
required by the mortgage document, as applicable, have been sent to the Defendant(s) on
the date(s) set forth thereon.

LEGAL DESCRIPTION
ALL THAT CERTAIN two and a half story brick dwelling house numbered 202 West Main
Street, being the Western half of a double house, and lot of ground situate in the Borough of
Mechanicsburg, County of Cumberland, and Commonwealth of Pennsylvania, bounded and
described as follows, to wit:
BEGINNING at a point on the building line of West Main Street and at a corner of property now
or formerly of Henry S. Kane, Jr., and Elizabeth H. Kane, his wife; thence Eastwardly along the
said building line 24 feet to a point on the Eastern line of an alleyway which separates the house
herein conveyed and the house on the property now or formerly of Harry E. Mullen and Faye E.
Mullen, his wife; thence Northwardly along the line of said property wich line runs from the
point above mentioned to the corner of the two-story brick stable and garage building, a distance
of 202 feet, more or less, to the South line of Strawberry Alley 22.5 feeet, more or less, to a point
at the corner of land now or formerly of said Henry S. Kane Jr., and Elizabeth H. Kane, his wife;
thence Southwardly along the line of said land now or formerly of said Henry S. Kane, Jr., and
Elizabeth H. Kane, his wife, a distance of 202 feet, more or less, to the building line of West
Main Street, the Place of BEGINNING.
THIS CONVEYANCE is made subject, however, to the right of egress, ingress, and regress, on
the part of the owners of the land adjacent hereto on the East, their heirs and assigns over the
four (4) foot passageway at the rear of the lot herein conveyed, which extends Southwardly from
the line of Strawberry Alley along the two-story brick stable and garage building on said
adjoining land to the corner of said building and a few feet beyond.

4. If the amount due from the Buyer is not paid to the Sheriff, you will remain the owner of the property as if
the sale never happened.

6. You may be entitled to a share of the money which was paid for your house. A proposed schedule of

Western half of a double house, and lot of ground situate in the Borough of Mechanicsburg, County of
Cumberland,',and Commonwealth of Pennsylvania, bounded and described as follows, to wit:
BEGINNING at a point on the building line of West Main Street and at a corner of property now or formerly
of Henry S. Dane, Jr., and Elizabeth H. Kane, his wife; thence Eastwardly along the said building line 24 feet
to a point on the Eastern line of an alleyway which separates the house herein conveyed and the house on the
property now or formerly of Harry E. Mullen and Faye E. Mullen, his wife; thence Northwardly along the
line of said property wich line runs from the point above mentioned to the corner of the two-story brick stable
and garage building, a distance of 202 feet, more or less, to the South line of Strawberry Alley 22.5 feeet,

To prevent this Sheriff's Sale, you must take immediate action:
1. The sale will be canceled if you pay to the mortgagee the back payments, late charges, costs and

2. You may be able to stop the sale by filing a petition asking the Court to strike or open the judgment,
if the judgment was improperly entered. You may also ask the Court to postpone the sale for good cause.

Western half~of a double house, and lot of ground situate in the Borough of Mechanicsburg. County of
Cumberland. and Commonwealth of Pennsylvania, bounded and described as follows. to wit:
BEGINNING at a point on the building line of West Main Street and at a corner of property now or formerly
of Henry S. k:ane, Jr., and Elizabeth H. Kane, his wife; thence Eastwardly along the said building ]nle 24 feet
to a point on the Eastern line of an alleyway which separates the house herein conveyed and the house on the
property now or formerly of Harry E. Mullen and Faye E. Mullen, his wife; thence Northwardly along the
line of said property wick line runs from the point above mentioned to the corner of the. two-story brick stable
and garage building, a distance of 202 feet, more or less, to the South line of Strawberry .Alley 22.5 feeet,
