Whereas, Costello Builders, Inc. (`Contractor.) of 5501 Main Street
Fast Peb aburg, PA 17520, has entered into a contract with Christopher H. Materngoe and Penny Metargm ('Owner") of
6117 Mlbw* Drive, Mechanicsburg, PA 17050, for the erection or oonatruction of a SINGLE FAMILY DWELLING upon
the lot of ground known as 6103 Milbank Drive - Lot #4, Mechanicsburg, PA 1705oHampden Township, Cumberland
County. Penrsiyhrania, described in Exhibit W hereof, of which Christopher H. Metangos and Penny Matengoe are the title
holder of record; and
Whereas, it is the intention of Owner and Contractor that neither said lot of ground nor the improvernatts erected
or to be erected thereon shall be subject to a lien for debts due Owner to Contractor or by Contractor to any eubOOrftrVzW
for labor or materials furnished in the said erection or oonstrudlon, and that the right of anyone to claim ary such lien be
waived hereby.
Now, This Agreement Witnesseth: That Contractor, for and in consideration of the contract aforesaid and the
considerations mentioned thereunder, as wed as the further consideration of One Dollar ($1.00) to it in hand paid by the
Owner at or before this seeing and delhrery of these presents, the receipt of which is hereby acknowledged, and intending
to be 1 dy hound hereby does hereby covenant, promise and agree, for Contractor and any and ad subcontractors,
materiahnen, laborers and parties acting for, through or under Contractor, that no mechanics' den or dakn or other den or
claim of any kind whatsoever shad be filed or maintained against the budding, improvements, lot of ground or any part
hereof, or the curtilage or curillages appurtenant thereto by anyone, and that all subcontractors, mabrlalmen and laborers
shall look to and hold Contractor personally cable for all suboorntrads, materiels furnished and work and labor done.
And this agreement, waiving the right of Ilan by anyone, shed be an independent oovenent and shall operate and
be effective with reaped to work done and materials famished under any supplemental contract for extra work in the
erection, construction and completion of the budding as well as to any work and labor done and materials furnished under
the contract aforesaid.
And, in order to give the Owner full power and authority to proted Owner and the building, improvements and lot
of ground, against any and all claims tiled by Contractor or anyone acting under or through Contractor in vbhftn of the
foregoing covenant, Contractor hereby Irrevocably authorizes and empowers any Attorney of any Court of Common Pleas
of the Cornmonwealth of Pennsylvania to appear for Contractor in any of the said Courts of Common Plans as attorney for
Contractor and in Contracor's name, mark satisfied of record at the cost and expense of the Contractor, or of any
subcontractor or materdalman, any and all claims or claim, dens or Ilan, filed by or for the Contractor, or any subcontractor
or materialmen, or in the new of any one or more of thorn against the building, Improvements, lot of ground or any part
thereof, and, or such act or acts, this shad be good and sufficient warrant and authority, and a reference to the Court,
Term and Number in which this instrument shell have been teed shall be a sutlident exhibit of the authority herein
contained to warrant such action, and the Contractor does hereby remise, release, and quit claim all rights and all manner
of errors, defects and imperfections whatsoever In entering such satisfaction of in anywise touching or concerning the
sane.

ALL THAT CERTAIN lot or piece of ground situate in Hampden Township, County of Cumberland, Commonwealth of
Pennsylvania, more particularly bounded and described as follows, to wit
BEGINNING at a point on the northern dedicated right-of-way line of Milbank Drive at the dirviding line between Lot #3 and
Lot #4, said point also being looted 103.30 feet from the northwest corner of Milbank Drive and Skyport Road.
THENCE by the northern right-of-way iris of Milbank Drive North 50 degrees 03 minutes 46 seconds West 44.89 feet to a
point: thence pond nukV by some by a cwve to the right havirg a radius of 75.00 feet an arc length of 94.96 feet 10 a point;
thence by same North 22 degrees 29 minutes 00 seconds East 34.70 test to a point at the dividig Ike of Lot 94 and Lot
;15; thence by Lot 05 South 67 degrees 31 minutes 00 seconds East 132.97 feet to a point on the line of Lot 92: thence by
line of Lot #2 and Lot #3 South 39 degrees 56 minutes 14 seconds West 125.49 That to a point being the place of
BEGINNING.
BEING all of Lot #4 as shown on Final Subdivision Plan of Milbank Estates, Phage 1.

BEING the same premises which Robert L. Slagle, If and Richard B. Slagle both iMhrldually and along with Robert L
Jones, as Executors of the Last Will and Testament of Hide J. Slagle, aWa H. Judy Slagle, Hilda Carolyn Slagle, by deed
dated November 11, 2012 and recorded November 23, 2011 to the Office of the Recorder of Deeds in and for Cumberland
County, Pennsylvania, as koftument No. 201132626 granted and conveyed unto
Christopher H. Matangos and Penny Melanges, husband and wife.
