Brenneman, Esquire, Assistant Cumberland County Solicitor, files this Motion for Service Pursuant to Special Order of Court by Publication Pursuant to Pa. R.C.P. 430, as follows: 1. On April 11, 2013, Petitioner, the Cumberland County Tax Claim Bureau, filed a Petition for Rule for Judicial Sale of the property of Rebecca Fahnestock known as Cumberland County tax parcel number 29-05-0425- 076 TR04203 to the above captioned term and number. 2. On April 18, 2013 this Court issued a Rule to Show Cause returnable August 2, 3013 at 9:30 a.m. in Courtroom 2, Cumberland County Courthouse, 4t" Floor, Carlisle, PA 17013 3. Service was not able to be made upon Rebecca Fahnestock at her address as disclosed by the public records, namely: 160 Gordon Drive, Carlisle, PA 17013 as indicated on the Sheriff's return hereto attached as Exhibit "A". 4. Movant made efforts to locate Rebecca Fahnestock as described in the address verification form attached hereto as Exhibit "B". Movant was unable to locate the Respondent. 5. On or about May 1, 2013, Movant received a telephone call from Guy W. Stouffer, the owner of the land where the subject mobile home is located and who is also the Respondent's father. He stated that Ms. Fahnestock had abandoned the home and he does not have any knowledge of her whereabouts. 6. Section 611 of the Real Estate Tax Sale Law (P.S. 5860.611) provides that if the Sheriff cannot find the party at their last known address, no further service is required. However, Movant desires that the owner be additionally served by publication. WHEREFORE, Movant prays your Honorable Court as follows: Order service of the Rule to Show Cause, Pursuant to Pa R.C.P. 430, be made upon Rebecca Fahnestock by publication of the advertisement hereto as Exhibit "C" once in the Cumberland Law Journal and once in The Patriot News, at least 15 days Prior to the rule returnable date.
