Plaintiff is Kondaur Capital Corporation, duly organized and doing business at the above- captioned address. 2. The Defendant is Charles E. Weekley, who is the mortgagor and real owner of the mortgaged property hereinafter described, and his/her last-known address is 407 Bloserville (toad, Newville, Pennsylvania 17241. 3. The Defendant is Karen E. Weekley, who is the mortgagor and real owner of the mortgaged property hereinafter described, and his/her last-known address is 407 Bloserville Road, Newville, Pennsylvania 17241. 4. On December 9, 2005, mortgagors made, executed and delivered a mortgage upon the premises hereinafter described to Mortgage Electronic Registration Systems, Inc., acting solely as a nominee for Commerce Bank/Harrisburg, NA. which mortgage is recorded in the Office of the Recorder of Cumberland County in Mortgage Book 1934, Page 3105, such Mortgage being incorporated herein by reference by virtue of Rule 1019(g) Pa. R. C. P. 5. On March 13, 2007, the aforesaid mortgage was thereafter assigned by Mortgage Electronic Registration Systems, Inc., acting solely as a nominee for Commerce Bank/Harrisburg, NA. to EMC Mortgage Corporation, by Assignment of Mortgage, recorded in the Office of the Recorder of Cumberland County in Assignment of Mortgage Book 735, page 1368, such Assignment of Mortgage being incorporated herein by reference by virtue of Rule 1019(g) Pa. R. C. P. 6. On March 17, 2010, the aforesaid mortgage was thereafter assigned by EMC Mortgage Corporation to U.S. Bank National Association, as Trustee of Maiden Lane Asset-Backed Securities I Trust 2008-1, Without Recourse, by Assignment of Mortgage, recorded in the Office of the Recorder of Cumberland County in Assignment of Mortgage Instrument No. 201007346, such Assignment of Mortgage being incorporated herein by reference by virtue of Rule 1019(g) Pa. R. C. P. 7. The aforesaid mortgage was thereafter assigned by U.S. Bank National Association, as Trustee of Maiden Lane Asset-Backed Securities I Trust 2008-1, Without Recourse to Kondaur Capital Corporation, Plaintiff herein, by assignment which will be duly recorded in the office of the recorder for Cumberland County. 8. The premises subject to said mortgage is described in the legal description attached as Exhibit "A" and is known as 407 Bloserville Road, Newville, Pennsylvania 17241. 9. The mortgage is in default because monthly payments of principal and interest upon said mortgage due April 1, 2011 and each month thereafter are due and unpaid, and by the terms of said mortgage, upon default in such payments for a period of one month, the entire principal balance and all interest due thereon are collectible forthwith. 10. The following amounts are due on the mortgage: Principal Balance $ 99,806.89 Interest through March 8, 2012 $ 6,611.86 (Plus $17.77 per diem thereafter) Late Charges $ 168.95 Attorney's Fee $ 1,450.00 Corporate Advance $ 330.05 Escrow Advance $ 3,001.32 Suspense Balance $ (659.34) GRAND TOTAL $ 110,709.73 11. Notice of Intention to Foreclose under Act 6 of 1974 (41 P.S. §403) was sent to Defendant by certified mail, return receipt requested as required by that Act. Notice under the Homeowner's Emergency Mortgage Assistance Act (Act 91) was not provided as the provisions of such Act were not applicable at that time and no notice under such Act was required. This is an action in mortgage foreclosure brought by Kondaur Capital Corporation against Charles E. Weekley, Sr, and Karen E. Weekley. 2. This case is currently under a stay pursuant to paragraph (b) of the Cumberland County Administrative Order dated February 28, 2012, which establishes the Mortgage Foreclosure Diversion Program. 3. Plaintiff and Defendants attended a conciliation conference on September 27, 2013. 4. Pursuant to the Order dated September 27, 2013, Defendants were to elect one of three settlement proposals presented by Plaintiff or request a continued conciliation conference within seven(7) days of the September 27,2013 conciliation conference. 5. The parties are unable to reach an agreement because Defendants failed to timely notify the Court of their intent to accept one of the aforementioned settlement options or request a further conference. 6. For the reasons set forth herein,the aforementioned stay of proceedings should be lifted to allow Plaintiff to proceed with the instant mortgage foreclosure action.
