Corporation, hereinafter referred to as Contractor,
2004, by and
a Pennsylvania
Timothy D. Hoffman, hereinafter referred to as Owners, whereby the
contractor undertook and agreed to erected and construct a dwelling
on the certain lot of ground situate in Cumberland County,
Commonwealth of Pennsylvania, and more fully described in Exhibit
"A" which is attached hereto and made a part hereof known as Lots
91, 92, and 93 Walnut Court, Georgetown Circle, Cumberland County,
Carlisle, PA 17013.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall be
filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot above
described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right of
lien, shall be an independent covenant.

Hoffman who acknowledged himself to be the President of Hoffman's
Custom Contracting, Inc. and that he as such President being

ALL THOSE CERTAIN TRACTS of land situate in the Borough of Carlisle,
Cumberland County, Pennsylvania, appearing as Lots 91, 92 and 93 on Phase III of the
Final Subdivision Plan of Walnut Court as recorded in Cumberland County Plan Book
62, Page 58 and being more particularly bounded and described in accordance with said
subdivision plan as follows:
LOT 91: BEGINNING at a point along the right of way for Georgetown Circle at the
dividing line between Lots 91 and 92 on the hereinafter mentioned Plan of Lots; thence
along said dividing line, South 6 degrees 15 minutes 00 seconds East, 160.00 feet to a
point at other lands of Grantors; thence along said lands, South 83 degrees 45minutes 00
seconds West, 30.00 feet to a point at the dividing line between Lots 90 and 91; thence
along said dividing line North 6 degrees 15 minutes 00 seconds West, 160.00 feet to a
point along the right of way for Georgetown Circle; thence along said Georgetown
Cimle, North 83 degrees 45 minutes 00 seconds East, 30.00 feet to a point; the place of
BEGINNING.
BEING Lot No. 91 on Phase III of the Final Subdivision Plan of Walnut Court as
recorded in Cumberland County Plan Book 62, Page 58.
LOT 92: BEGINNING at a point along the right of way for Georgetown Cimle at the
dividing line between Lots 92 and 93 on the hereinafter mentioned Plan of Lots; thence
along said dividing line, South 6 degrees 15 minutes 00 seconds West, 161.60 feet to a
point at other lands of Grantors; thence along said lands, South 83 degrees 45 minutes 00
seconds West, 30.00 feet to a point at the dividing line between Lots 91 and 92; thence
along said dividing line North 6 degrees 15 minutes 00 seconds West, 160.00 feet to a
point along the right of way for Georgetown Circle; thence along said Georgetown
Circle, North 83 degrees 45 minutes 00 seconds East, 9.65 feet to a point; thence
continuing by a curve extending in a Southeasterly direction with a radius of 130.00 feet,
and an arc length of 20.44 feet to a point; the place of BEGINNING.
BEING Lot No. 92 on Phase III of the Final Subdivision Plan of Walnut Court as
recorded in Cumberland County Plan Book 62, Page 58.
LOT 93: BEGINNING at a point along the right of way for Georgetown Circle at the
dividing line between Lots 93 and a twenty foot buffer yard as shown on the hereinafter
mentioned Plan of Lots; thence along said dividing line, South 6 degrees 15 minutes 00
seconds West, 180.68 feet to a point at the dividing line between Lots 93 and other lands
of Grantors; thence along said dividing line, South 83 degrees 45 minutes 00 seconds
West, 50.00 feet to a point at the dividing line between Lots 92 and 93; thence along said
dividing line North 6 degrees 15 minutes 00 seconds West, 161.60 feet to a point along
the right of way for Georgetown Circle; thence along said Georgetown Circle by a curve
extending in a Northeasterly direction with a radius of 130.00 feet, an arc length of 53.90
feet to a point; the place of BEGINNING.
