Ehgartner, Jr. of Harrisburg is about to execute contemporaneously herewith, a contract, with of Haubert Homes, Inc. Pennsylvania, Pennsylvania, for the erection of a st~ single family home building upon a lot of land situate See Attached Exhibit A NOW, September 24, 2004 ~:"bO/at. the time of and immediately before the execution of the prin- cipal contract, and before any authority has been given by the said George J. Ehgartner, Jr. to the said Haubert Homes, Inc. to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Haubert Homes, Inc. and the further consideration of One Dollar. to Hauber, Homes, Thc. paid by George J. Ehgartner, Jr. . it is agreed that no lien shall be filed against the building by the contractor, or any sub--contractor~ nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. S~LND SEALED IN THE PRESENCE OF Exhibit "A" File No. 04-464 ALL THAT CERTAIN tract or parcel of land situate in the Township of East Pennsboro, County of Cumberland, Commonwealth of Pennsylvania more particularly bounded and described as follows, to wit: BEGINNING at a point on the eastern right-of-way line of Willow Way Drive (50' wide) at the dividing line between Lots #184 and #185 as shown on the hereinafter mentioned plan; Thence along the eastern right-of-way line of Willow Way Drive North 34 degrees 43 minutes 21 seconds West, a distance of 115.00 feet to a point at the dividing line between Lots #185 and #186; Thence along the dividing line between Lots #185 and #186, North 55 degrees 16 minutes 29 seconds East, a distance of 114.67 feet to a point on the western line of Lot #178; Thence along the dividing line between Lots #178 and #185, South 31 degrees 01 minutes 58 seconds East, a distance of 115.24 feet to a point at the dividing line between Lots #178, #183, #184 and #185; Thence along the dividing line between Lots #184 and #185, South 55 degrees 16 minutes 39 seconds West, a distance of 107.26 feet to a point on the eastern right-of-way line of Willow Way Drive, said point being the place of BEGINNING. BEING Lot #185 as shown on the Final Subdivision Plan of Penn Valley, Phase 3, recorded in Plan Book 78, Page 114. CONTAINING approximately 12,760.79 square feet. Grantee is advised that all or part of the parcel being conveyed by this deed contains fill over wetland arrears and appropriate measures should be employed in construction to insure adequate drainage and foundation stability for any structure erected over such fill areas. BEING THE SAME PREMISES which LOGAN'S RUN ASSOCIATES,, A Pennsylvania General Partner and HAUBERT HOMES, Inc., A Pennsylvania Corporation by Deed dated September 23, 2004 and intended for immediate recording in the Office of the Recorder of Deeds in and for Cumberland, Pennsylvania, granted and conveyed unto GEORGE J.
