FIRST IDENTITY OF TESTATRIX'S FAMILY I declare that I am not now married. I have no children. SECOND PROPERTY BEING DISPOSED It is my intention by this Will to dispose of all the property which I may own. THIRD BURIAL INSTUCTIONS It is my desire that a funeral and burial consistent with my economic status in life be conducted as soon as may be practicable following my death and that my remains be buried at the SS. Peter and'' Paul Orthodox Church Cemetery in Windber, Pennsylvania, in the Balog family plot. In m~ distribution, I have included a percentage bequest to the church for perpetual maintenance of the Balog grave site. It is my desire that my personal representatives ensure that Page 1 of 10 ~~ any special needs to my family headstones and plot, including, but not limited to, repair of sinking, erosion, topsoil replacement and the like, shall be performed as a continuing condition to the acceptance of the bequest by the church. I further direct my personal representatives to contact the William Kisiel Funeral Home presently located at 1015 Graham Avenue, Windber, Pennsylvania, as I have previously made arrangements with that funeral home for my burial. FO- DISPOSITION OF ESTATE Payment of Obligations I direct that my executor pay the cost of my funeral services and all debts which I am legally obligated tq pay whether owing at the time of my death or pursuant to my final medical care. I further direct my executors to pay the costs for purchase and erection of a suitable grave monument with inscription thereon and a burial plot with perpetual care as a final resting place for me if same shall not already been purchased. Disposition I give, devise and bequeath the following property with all insurance proceeds thereon as follows: 1. To my nephew, Gregory Burch, I give and bequeath the following: a) Oriental art and lamps he gave me as gifts; b) China and silverware and other art work: Egyptian; Mexican; Greek; and Chinese; c) Furniture of his choice; d) Crystal from Czechoslovakia; e) Music boxes; f) German Tankards; g) Hummel and Llardo figurines; h) Crystal art works and linens. ~~ Page 2 of 10 2. To my niece, Phyllis (Blazosky) Slonac, I give and bequeath the second choice of items not selected by Gregory Burch. 3. To the Windber Library, Windber, Pennsylvania: a) Choice of any art books in my personal library; b) Selection of any books in my personal library. 4. Any articles that the aforementioned do not want shall be first offered to any of the' other beneficiaries. Any articles that shall remain shall be sold and the proceeds thereof added to my residual estate. In the event that I do not possess any of the above-referenced property at the time of my death, my estate shall not be c-bligated to obtain these items and those bequests shall lapse. Page 4 of 10 ~~ FIFTH In the event that my nephew, Gregory Burch, of Charles Town, West Virginia, predeceases me, or dies on or before the Thirtieth (30`h) day following my death, one-half (1/2) of his share shall pass to his mother, Helen Burch, and the other one-half (1/2) will be distributed to the surviving residual heirs, on a pro-rated basis, according to each surviving residual heir's percentage of my residual estate. In the event that both Gregory Burch and his mother, Helen Burch, predecease me, then share that would have gone to Gregory Burch shall be distributed to the surviving residual heirs on a pro-rated basis according to each surviving residual heir's percentage of my residual estate. Should any of my other beneficiaries predecease me, or die on or before the Thirtieth (30`h) day following my death, that individual's portion of my estate shall pass per stirpes. SI- GENERAL Effect of Inoperative, Invalid or Illegal Provision If any provision of this will, or of any codicil thereto, is held to be inoperative, invalid or illegal, it is my intention that all of the remaining provisions thereof, shall continue to be fully operative and effecCive so far as is possible and reasonable. Page 5 of 10 I Y~~ SEVENTH CO-EXECUTORS Appointment I appoint my niece, Phyllis Slonac, of St. Michael, Pennsylvania, and my nephew, Gregory Burch, of Charles Town, West Virginia, or the survivor of them, as Co-Executors of this, my Last Wi1T~ and Testament. In the event that either or both of them should predecease me, then I nominate at~d appoint my sister, Helen (Balog) Burch of Charles Town, West Virginia, as my Executrix in their place and stead. Bond No bond or other security shall be required of any Executor appointed in this Will. Powers My Co-Executors shall have, in addition to and not in limitation of, the powers given by law or any other pjrovisions of this Will, the following powers with respect to the settlement of my estate, to be eixercised in each case from time to time in the discretion of my Executor without further order or license of the Register of Wills or of any court: (a) To retain all property received including the stock of any corporate fiduciary acting hereunder, provided such property remains productive. (b) To join in any corporation, partnership, recapitalization, merger, reorganization or voting trust plan; to delegate authority with respect thereto; to deposit investments under agreements and pay assessments; and generally to exercise all rights of investors, including but not limited to, the voting of shares. (c) To manage, operate, repair, improve, mortgage or lease on any terms any real estate held or owned by my estate. (d) To operate any business that I may own at my death. Page 6 of 10 /,16~ (e) To invest any funds of my estate in any stocks, bonds, notes or other securities or property, real or personal, without regard to the principle of diversification or any other statute or general rule of law in their absolute discretion, it being my intention to give my personal representatives tl~e broadest investment powers possible, providing such investments do not unnecessarily prevent the prompt settlement of my estate. (f) To sell or otherwise dispose of any property, real or personal, tangible or intangible, at any time forming a part of my estate in any manner and on such terms and conditions as my personal representatives shall see fit in their absolute discretion. (g) To',borrow money for the payment of taxes or for any other proper purposes in the administration of my estate, and to mortgage or pledge estate assets as security. (h) To compromise claims without court approval including, but not limited to, any controversies with the United States of America or the Commonwealth of Pennsylvania concerning estate sand inheritance taxes on any interests that may pass under this my Last Will and Testament. (i) To distribute in cash or in kind upon any division or distribution of my estate. (j) To .undertake any and all acts deemed necessary and proper by my personal representatives fore. the proper, advantageous and prompt management of the settlement of my estate. (k) In general, to exercise all powers in the management of my estate which any individual could exercise in the management of similar property owned in his own right, upon such terms and conditions as to them may seem best and to execute and deliver all instruments and to do all acts wlhich they deem necessary or proper to carry out the purposes of this, my Last Will and Testamenti. Page7of10 ~ri2 EIGHTH No interest of any beneficiary of my estate, either in income or in principal, shall be subject to anticipation or pledge, assignment, sale or transfer in any manner, nor shall any beneficiary have ',the power in any manner to charge or encumber his or her interest either in income or principal, nor shall the interest of any beneficiary be liable or subject in any manner while in the possejssion of my personal representatives for the liability of such beneficiary.
