PETITION FOR RULE FOR JUDICIAL SALE
AND NOW, comes the Cumberland County Tax Claim Bureau, by its attorney,
Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor, and files this Petition
for Rule for Judicial Sale, of which the following is a statement:
1. Your Petitioner is the County of Cumberland through its Tax Claim Bureau,
a Bureau created by the Real Estate Tax Sale Law. 72 P.S. §5860.101, et
sic.
2. Pursuant to 72 P.S. §5860.610, your Petitioner respectfully represents as
follows:
a. Tax claim upon which the property was exposed for sale:
2009 and 2010 Cumberland County and Upper Frankford Township
real estate taxes. 2009-10 and 2010-11 Big Spring School District
real estate taxes. Total amount of claim, including penalty, interest,
and cost as of date of tax sale: $1,333.42.
b. Neither the owner, his, her, their, or its heirs, successors, assigns,
or legal representatives, or any lien creditor, or his, her, their or its
heirs, successors or legal representatives, or any other person
interested, has caused stay of sale, discharge of tax claim or
removal from tax sale.

C. The property was exposed to public sale pursuant to 72 P.S.
§5860.601 on: December 12, 2011.
d. Before exposing the property to public sale the Bureau fixed
the upset sale price, pursuant to 27 P.S. §5860.605, which upset
price was $ 1,599.23.
e. Your Petitioner, the Bureau, was unable to obtain a bid at
the public sale sufficient to pay the said upset price.
3. Attached hereto, marked Exhibit 'A" and incorporated herein by reference
as if fully set forth herein, is a copy of a vehicle record abstract from the
Pennsylvania Department of Transportation, Bureau of Motor Vehicles,
referencing the mobile home by V.I.N. number 6A111178H and owners
as Danielle E. and Randall Zeigler. The tax parcel number of the property
as recorded in the Cumberland County assessment office is 43-05-0417-
028B TR03323 and owners as Randal and Danielle Zeigler. The property
is situate in the Township Upper Frankford, Cumberland County,
Pennsylvania, and is known as 661 Mohawk Road.
4. The names and addresses of known parties holding tax and municipal
claims, liens, mortgages, ground rents, charges and estates against the
property are as follows:

5. The last known address of the owner of the property as set forth in
the assessment records of Cumberland County is: Randal and Danielle
Zeigler, 128 Leeds Road, Newville, PA 17241. Certified mail sent to said
address was signed for by Darlene Armolt. As indicated on the Additional
Notification Efforts Form attached hereto as Exhibit "C", the Bureau
acquired an additional address at 66 E Street, Apt. 1 Carlisle PA 17013.
Certified mail sent to the E Street address was retuned attempted not
known. Per the Upper Frankford Tax Collector and the Cumberland
County Sheriff, the subject property is vacant. Therefore, your Petitioner
requests that the Court's Rule to Show Cause be served upon Randal E.
Zeigler and Danielle E. Zeigler by publication of the advertisement hereto
attached as Exhibit "D" once in the Cumberland Law Journal, and once in
the Patriot News at least fifteen days prior to the rule returnable date,
pursuant to PA R.C.P 430.
WHEREFORE, Your Petitioner prays your Honorable Court to grant a rule upon
all interested parties, including those listed at paragraphs four and five of the within
Petition, to show cause why a decree should not be made that the property be sold,
freed and cleared of tax and municipal claims, liens, mortgages, charges and estates,
except separately taxed ground rents, pursuant to Section 612 of the Real Estate Tax
Sale Law. 72 P.S. §5860.612(a).

PETITION FOR RULE FOR JUDICIAL SALE
AND NOW, comes the Cumberland County Tax Claim Bureau, by its attorney,
Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor, and files this Petition
for Rule for Judicial Sale, of which the following is a statement:
1. Your Petitioner is the County of Cumberland through its Tax Claim Bureau,
a Bureau created by the Real Estate Tax Sale Law. 72 P.S. §5860.101, of
sic.
2. Pursuant to 72 P.S. §5860.610, your Petitioner respectfully represents as
follows:
a. Tax claim upon which the property was exposed for sale:
2009 and 2010 Cumberland County and Upper Frankford Township
real estate taxes. 2009-10 and 2010-11 Big Spring School District
real estate taxes. Total amount of claim, including penalty, interest,
and cost as of date of tax sale: $1,333.42.
b. Neither the owner, his, her, their; or its heirs, successors, assigns,
or legal representatives Qr any lien creditor, or his, her, their or its
heirs, successors or legal representatives, or any other person
interested, has caused stay of sale, discharge of tax claim or
removal from tax sale.

C. The property was exposed to public sale pursuant to 72 P.S.
§5860.601 on: December 12, 2011.
d. Before exposing the property to public sale the Bureau fixed
the upset sale price, pursuant to 27 P.S. §5860.605, which upset
price was $ 1,599.23.
e. Your Petitioner, the Bureau, was unable to obtain a bid at
the public sale sufficient to pay the said upset price.
3. Attached hereto, marked Exhibit 'A" and incorporated herein by reference
as if fully set forth herein, is a copy of a vehicle record abstract from the
Pennsylvania Department of Transportation, Bureau of Motor Vehicles,
referencing the mobile home by V.I.N. number 6A111178H and owners
as Danielle E. and Randall Zeigler. The tax parcel number of the property
as recorded in the Cumberland County assessment office is 43-05-0417-
0286 TR03323 and owners as Randal and Danielle Zeigler. The property
is situate in the Township Upper Frankford, Cumberland County,
Pennsylvania, and is known as 661 Mohawk Road.
4. The names and addresses of known parties holding tax and municipal
claims, liens, mortgages, ground rents, charges and estates against the
property are as follows:

5. The last known address of the owner of the property as set forth in
the assessment records of Cumberland County is: Randal and Danielle
Zeigler,128 Leeds Road, Newville, PA 17241. Certified mail sent to said
address was signed for by Darlene Armolt. As indicated on the Additional
Notification Efforts Form attached hereto as Exhibit "C", the Bureau
acquired an additional address at 66 E Street, Apt. 1 Carlisle PA 17013.
Certified mail sent to the E Street address was retuned attempted not
known. Per the Upper Frankford Tax Collector and the Cumberland
County Sheriff, the subject property is vacant. Therefore, your Petitioner
requests that the Court's Rule to Show Cause be served upon Randal E.
Zeigler and Danielle E. Zeigler by publication of the advertisement hereto
attached as Exhibit "D" once in the Cumberland Law Journal, and once in
the Patriot News at least fifteen days prior to the rule returnable date,
pursuant to PA R.C.P 430.
WHEREFORE, Your Petitioner prays your Honorable Court to grant a rule upon
all interested parties, including those listed at paragraphs four and five of the within
Petition, to show cause why a decree should not be made that the property be sold,
freed and cleared of tax and municipal claims, liens, mortgages, charges and estates,
except separately taxed ground rents, pursuant to Section 612 of the Real Estate Tax
Sale Law. 72 P.S. §5860.612(a).

AND NOW, comes the Cumberland County Tax Claim Bureau, by its attorney,
Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor, and files this Motion
for Service Pursuant to Special Order of Court by Publication Pursuant to Pa. R.C.P.
430, of which the following is a statement:.
1. On or about February 27, 2012 your Petitioner, the Cumberland County Tax
Claim Bureau, filed a Petition for Rule for Judicial Sale of the property of Randall Zeigler
and Danielle Zeigler known as Cumberland County tax parcel number 43-05-0417-028B
TR03323 to the above captioned term and number.
2. On April 3, 2012 your Honor issued a Rule to Show Cause returnable June,

3. At the June 22, 2012 Rule to Show Cause hearing, you Honor issued an
Order to Continue the Matter generally.
4. Service was not able to be made upon the Respondent's creditor, New Image
Home Sales, at their address as disclosed by public records, to wit: 7066 Carlisle Pike,
Carlisle, PA 17015 as indicated on the Sheriffs return hereto attached as Exhibit "A".
5. Movant made efforts to locate New Image Home Sales as described in the
additional notification efforts form attached hereto as Exhibit "B". Movant was unable to
locate New Image Home Sales and phone numbers listed on the internet search are
incorrect.
6. Section 611 of the Real Estate Tax Sale Law (72 P.S. 5860.611) provides that
if the Sheriff cannot find the party at their last known address, no further service is
required. However, Movant desires that said creditor be additionally served by
publication.
WHEREFORE, Movant prays your Honorable Court as follows:
Order the Rule Returnable hearing that was originally scheduled for June 22,
2012 be rescheduled and service of the Rule to Show Cause, Pursuant to Pa R.C.P.
430, be made upon New Image Home Sales by publication of the advertisement hereto
as Exhibit "C" once in the Cumberland Law Journal and once in The Patriot News, at
least 15 days Prior to the rule returnable date.
