V~~ I`J \~ ~ -r, l~C's, III, ~d moves to make the Citation issued March 12, 2012, absolute for the following reas~fis: ~-~ 1 • Daniel V. Scambia (hereinafter "Decedent"), died on January 18, 2012. c~ 2. Decedent died testate, however, the executor named in Decedent's will, died December 7, 2007. 3• Movant filed a Petition for Issuance of Citation (hereinafter "Petition") directed to each and every living residual beneficiary in Decedent's will requesting cause be shown, if any, why Movant should not be entitled to be issued letters of administration, c.t.a. 4. A Citation was issued on March 12, 2012, providing the residual beneficiaries twenty (20) days to file a response. 5• Upon information and belief, all residual beneficiaries received the Citation as none were returned by the United States Postal Service. 6. During the response period, the Register's Office received an e-mail from Nancy Scambia-Toole. 7. Shortly after being notified of that e-mail, Attorney Walters conducted a telephone conversation with Ms. Scambia-Toole to discuss her objection, if any she had. 8. Based on that telephone conversation, Movant believes and therefore avers, Ms. Scambia-Toole does not have any objection to the issuing of letters of administration, c.t.a to Movant. 9. Similarly, no response or objection to the Petition from any of the other residual beneficiaries has been received. - Tj ~~'. _ ;~ r~, ~._~ WHEREFORE, Movant Nicole L. Hook requests the Office of the Register of Wills, Cumberland County, Pennsylvania, grant her motion to make the Citation issued March 12, 2012, absolute and issue letters of administration, c.t.a.
