DISCLAIMER OF INTEREST PURSUANT TO 20 Pa. C.S.A. §6201
KELLY T. BOYLE, KERRY ANN KENNEY, KAREN T. BOLUS, and KATHLEEN E.
BADDICK, beneficiaries under the Will dated February 5, 2009, of JAMES. A. THORNE,
deceased, hereby state as follows:
1. JAMES A. THORNE died on October 17, 2010, leaving a will dated February 5,
2009, which was admitted to probate by the Register of Wills of Cumberland
County, Pennsylvania and Letters of Administration thereon were granted to
Kathleen E. Baddick on January 25, 2011.
2. KELLY T. BOYLE, KERRY ANN KENNEY, KAREN T. BOLUS, and
KATHLEEN E. BADDICK, beneficiaries, are entitled under ITEM II of
Decedent's Last Will and Testament to share equally in the distribution of the net
assets of the Estate, both real and personal property. The provisions of ITEM II
of said Last Will and Testament of JAMES A. THORNE are as follows:
"I give, devise and bequeath all the rest, residue and remainder of my
estate, of whatsoever nature and wheresoever situate at the time of
my death, to my children, Kelly T. Boyle, Kerry Ann Kenney, Karen
T. Bolus, and Kathleen E. Baddick, in equal shares.
3. All beneficiaries are parties to an Interim Settlement Agreement of the Estate of
JAMES A. THORNE, the terms and conditions of which are incorporated herein
by reference.
4. As all the Beneficiaries under the Last Will and Testament of JAMES A.
THORNE, deceased, the undersigned and each of them hereby disclaim all of
their interest in the real estate owned by the deceased as of the date of his
death.
5. The Executrix, following execution of this disclaimer by all four (4) beneficiaries,
is authorized to sell the real estate to Jane D. Carroll under and pursuant to the
terms of the Interim Settlement Agreement.
6. In addition to disclaiming her interest in the deceased's real estate, KELLY T.
BOYLE, as one of the beneficiaries under the Last Will and Testament of JAMES
A. THORNE, deceased, hereby disclaims her interest in the balance of the assets
of the estate, intending to disclaim her interest in the entire estate pursuant to the
terms of the Interim Settlement Agreement.
7. As a consequence of the disclaimer by KELLY T. BOYLE in Paragraph 6 above,
the rest, residue and remainder of the estate now shall pass to the remaining
beneficiaries, KERRY ANN KENNEY, KAREN T. BOLUS, and KATHLEEN E.
BADDICK.
8. KELLY T. BOYLE, KERRY ANN KENNEY, KAREN T. BOLUS, and
KATHLEEN E. BADDICK, beneficiaries, under the Last Will and Testament of
JAMES A. THORNE, deceased, intend to deliver this disclaimer to the Executrix,
Kathleen E. Baddick, under the Last Will and Testament of JAMES A. THORNE,
deceased, and, to file it with the Clerk of the Orphans' Court Division of the
Court of Common Pleas of Cumberland County, Pennsylvania, pursuant to 20 Pa.
C.S.A. §6204.
