Black d/b/a Black's Detachable Truck Systems, alleges as follows: 1. Plaintiff, Citizens Bank of Pennsylvania (the "Bank"), is a Pennsylvania banking institution with an address of 443 Jefferson Boulevard West, Warwick, RI 02886. 2. Defendant, Farrell S. Black is an adult individual, doing business as Black's Detachable Trust Systems ("Borrower"), with an address of 300 Mulberry Drive, Mechanicsburg, PA 17050. 3. On or about June 9, 2006, in consideration of monies lent, Borrower executed and delivered to Citizens Bank a business credit application pursuant to which a business line of credit was established in its favor in the original principal amount of $30,000.00 in accordance with the terms and conditions set forth in the credit application (the "Line of Credit"). A true and correct copy of the business credit application and related documentation attached hereto and made a part hereof as Exhibit "A". 4. The Line of Credit is commercial in nature and did not arise from, nor is it in connection with, a consumer credit transaction. 5. Borrower has drawn on and received funds from the Bank in connection with the Line of Credit. 6. As of February 2, 2012, there remains the principal sum of $26,891.26.00 plus interest and other fees and expenses outstanding pursuant to the Line of Credit. 7. Borrower has defaulted on its obligations to the Bank under the Line of Credit by virtue of, among things, failing to make payments in accordance with terms and conditions of the Line of Credit, and failing to repay the Bank after written demand. A true and correct copy of a written notice of default and demand for payment is attached hereto and made a part hereof as Exhibit "B." 8. As a result of said defaults, Borrower is in default and the following amounts are immediately due and payable under and in connection with the Line of Credit, as modified, as of February 2, 2012: Principal $26,891.26 Interest $ 257.38 Late charge $ 70.00 TOTAL $27,218.64 Interest continues to accrue from February 2, 2012, at a per diem rate of $3.86. 14. In addition, the Bank is entitled to recover all its collection expenses, including without limitation, its attorney's fees. At this point, assuming that Borrower does not interpose a defense to the entry of judgment, the attorneys' fees are estimated to be $1,000.00. -2- To the extent that the Borrower interposes a defense and/or that additional fees are incurred over and above $1,000.00, Citizens Bank is entitled to recover said fees. WHEREFORE, the Plaintiff, Citizens Bank of Pennsylvania, respectfully requests judgment in its favor and against Defendant, Farrell S.
