ORPHAN'S COURT
RESPONSE TO PETITION FOR APPOINTMENT OF GUARDIAN
1) Your Petitioner is Robert L. O'Brien, Esquire, Solicitor for the
Cumberland/Perry County Mental Health/IDD office.
2) Respondent is Jeffrey David Sweet, Jr., an incapacitated person, represented
by Cindy L. Villanella, Esquire, Guardian Ad Litem.
3) Respondent has filed an application to appoint MH/IDD as emergency
Plenary Guardian and as a permanent Plenary Guardian. Respondent has not sought the
consent of MH/IDD.
4) MH/IDD does not consent to the requested appointment as emergency
guardian or permanent guardian.
5) MH/IDD is not required to provide guardian services and has an interest
adverse to Mr. Sweet. The office is not a suitable temporary or permanent guardian.
WHEREFORE, Petitioner, Robert L. O'Brien, respectfully requests that the Court deny the
request that MH/IDD be appointed as Plenary Guardian.
