IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA CIVIL ACTION-LAW COMPLAINT NOW, comes Plaintiff, PharmaCare of Cumberland ("PharmaCare"), by and through its attorneys, O'BRIEN, BARIC & SCHERER, and files the within Complaint and, in support thereof, sets forth the following: 1. PharmaCare of Cumberland is a Maryland corporation with its principal place of business located at 1 James Day Drive, Cumberland, Maryland. PharmaCare is duly authorized to conduct business in the Commonwealth of Pennsylvania. 2. Defendant, Isabelle Varner, is an adult individual residing at 121 Walnut Bottom Road, Shippensburg, Cumberland County, Pennsylvania. 3. PharmaCare is in the business of selling and dispensing pharmaceutical products. 4. For a number of years, PharmaCare has been a supplier of pharmaceutical products to residents of the Shippensburg Health Care Center located at 121 Walnut Bottom Road, Shippensburg, Cumberland County, Pennsylvania. 5. Upon information and belief, Isabelle Vamer has been and curremly is a resident of the Shippensburg Health Care Center. 6. During the period April 20, 2004 to the present, PharmaCare has provided pharmaceutical products to Isabelle Vamer as referenced on Exhibit "A" which is attached hereto and incorporated by reference. 7. The charges for the pharmaceutical products provided by PharmaCare to Isabelle Vamer total $10,994.09 as further referenced on Exhibit 8. Despite demand therefore, Isabelle Vamer has failed and refused to pay PharmaCare for the pharmaceutical products provided. 9. All conditions precedent to recovery have been fulfilled. 10. The invoices sent to Isabelle Vamer by PharmaCare state that past due balances shall accrue a finance charge of 1.5% per month or 18% annually. COUNT I UNJUST ENRICHMENT Plaintiff incorporates by reference paragraphs one through ten as though set forth 11. at length. 12. Isabelle Varner has enjoyed the benefits of the pharmaceutical products provided to her by PharmaCare. 13. Isabelle Vamer has failed to pay for the pharmaceutical products provided by PharmaCare and has thus been unjustly enriched by the retention of the benefit without making payment. WHEREFORE, Plaintiffrequests judgment in its favor and against Isabelle Varner for the stun of $10,994.09 plus interest, costs and expenses and any additional mount coming due to the date of award. COUNT II BREACH OF CONTRACT 14. plaintiff incorporates by reference paragraphs one through thirteen as though set forth at length. 15. By placing orders for the pharmaceutical products listed on Exhibit '~A" with PharmaCare, Isabelle Vamer implicitly agreed to pay for the products provided by PharmaCare. 16. PharmaCare invoiced Isabelle Varner for the products provided each month. 17, Isabelle Varner has, without justification, failed and refused to pay for the products provided by PharmaCare. 18. Isabelle Varner's breach of her agreement to pay for the products has caused PharmaCare to not be paid. WHEREFORE, Plaintiff requests judgment in its favor and against Isabelle Vamer for the sum of $10,994.09 plus interest, costs and expenses, finance charges and any other mounts coming due to the date of award. COUNT III ACCOI3NT STATED 19. Plaintiff incorporates by reference paragraphs one through eighteen as though set forth at length. 20. Each month since April 20, 2004, PharmaCare has forwarded, in writing, a statement of account for the medications received by Isabelle Vamer from PharmaCare. 21. Isabelle Varner has received and reviewed these monthly account statements. 22. As no time has Isabelle Vamer ever disputed the mounts reflected on the monthly account statements. Isabelle Varner has expressly or impliedly accepted the monthly account 23. statements. WHEREFORE, Plaintiffrequest judgment in its favor and against Isabelle Vamer in the amount of $I0,994.09 plus costs, expenses, interest, finance charges and any additional amounts coming due to the date award.
