STIPULATION AGAINST LIENS
WHEREAS, Douglas E. Boeshore and Amy D. Boeshore, of Pennsylvania, is about
to execute contemporaneously herewith, a contract with Haubert Homes, Inc., a Pennsylvania
Corporation of Dauphin County, Pennsylvania, for the erection of a dwelling upon a lot of land
situate as follows:
ALL THAT CERTAIN piece or parcel of land situated in the Township of Lower
Allen, County of Cumberland and the Commonwealth of Pennsylvania, as shown as Lot No. 158 on
a plan entitled "The Heights of Beacon Hill, Final Subdivision Plan - Phase 3", as prepared by
Melham Associates, PC dated December 30, 2005, as revised February 28, 2006 and recorded in the
Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, more particularly
bounded and described as follows, to wit:
BEGINNING at a point, located on the easterly right-of-way line of Sagamore Court
(40 foot wide right-of-way), said point being a front property corner of Lot No. 158 and Lot No. 157;
thence along said easterly right-of-way line of Sagamore Court, along a curve to the left having a
radius of 50.00 feet and an arc distance of 39.07 feet, said arc being subtended by a chord of North
14 degrees 41 minutes 46 seconds East, a distance of 38.08 feet to a point, said point being a front
property corner of Lot No. 158 and Lot No. 159; thence along the boundary line between Lot No.
158 and Lot No. 159, North 88 degrees 28 minutes 55 seconds East, a distance of 168.19 feet to a

point, said point being a rear property corner of Lot No. 158 and Lot No. 162 and a front property
corner of Lot No. 159 and Lot No. 161 and being on the southwesterly right-of-way line of Yarmouth
Lane (50 foot wide right-of-way); thence along the boundary line between Lot No. 158 and Lot
No. 162, South 42 degrees 55 minutes 10 seconds West, a distance of 151.31 feet to a point, said
point being a rear corner of Lot No. 158, Lot No. 157, Lot No. 162 and Lot No. 163; thence along
the boundary line between Lot No. 158 and Lot No. 157, North 47 degrees 04 minutes 50 seconds
West, a distance of 102.08 feet to a point, said point being the POINT OF BEGINNING.
CONTAINING 10,701.50 square feet or.246 acres of land.
BEING TIJE SAME PREMISES which BHH Partners, a Pennsylvania Partnership,
by its deed dated the 13 day of April, 2012 and to be recorded simultaneously herewith, granted
and conveyed unto Douglas E. Boeshore and Amy D. Boeshore, husband and wife.
NOW, the (0? day of April, 2012, at the time of and immediately before the
execution of the principal contract, and before any authority has been given by the said Douglas E.
Boeshore and Amy D. Boeshore to the said Haubert Homes, Inc., a Pennsylvania Corporation to
commence work on the said building, or purchase materials for the same in consideration of the
making of the said contract with Haubert Homes, Inc., a Pennsylvania Corporation and the further
consideration of One Dollar, to Haubert Homes, Inc., a Pennsylvania Corporation paid by Douglas
E. Boeshore and Amy D. Boeshore it is agreed that no lien shall be filed against the building by the
contractor, any sub-contractor or any sub-sub-contractor, nor by any of the material men or
workmen or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly waived.
WITNESS, our hand and seals the day and year aforesaid.
