Prior to the guardianship hearing, Lavita was taken by Aging Staff to a Domestic Violence shelter because she had been assaulted by her grandson. She was later transported to Claremont Nursing and Rehab Center because she required more care than the shelter could provide. At the time of the hearing, Ms. Nickel was still a resident of the Claremont Nursing Rehabilitation Center where she continues to reside. At the time of her admission, her diagnoses were insulin dependent diabetes, neuropathy, acute anxiety, chronic paresthesias of extremities, hypothyroidism, hypertension, dermatitis. Since then she has been diagnosed with depression, dysphasia, dementia, gait dysfunction, weakness, left intertrochanteric hip fracture with repair, agitation, arteriosclerotic disease, macular degeneration, and urinary tract infections. On July 28, 2011 Ms. Nickel fell and sustained a hip fractured and required surgery. She returned to Claremont on August 1, 2011. The doctor ordered OT five times a week for four weeks for exercise activities and to show her how to manage her wheelchair. Following that, she received restorative therapy to increase her range of motion. She was again hospitalized on August 31, 2011 because of critically low hemoglobin and hematocrit levels. She received blood transfusions in order to correct these issues. Her behavior is at times disruptive with other residents. She often refuses to answer staff's questions or she gives some type of retort. She also gets into disagreements with other residents and recently pushed a staff member. Testing was done and it was determined that she had a urinary tract infection and has been placed on an antibiotic. The doctor also ordered an increase in her Exelon patch for dementia and decreased her anxiety medication. The Exelon patch was later discontinued due to skin irritation and she was placed on Aricept 5mg pills instead. Lavita continues to have interaction issues with other residents and staff. She will occasionally become involved with an activity but her favorite activity is to play with her 2 dolls. She was also taken birthday and Christmas presents. It is the request of Cumberland County Aging that the agency retain Guardianship of Person. Claremont Nursing and Rehab has demonstrated an adequate quality of care for her medical problems. We believe, therefore, that Ms. Nickel should continue to reside in that nursing facility. Guardian of Estate At the time of the guardianship, Ms. Nickel had a checking account at Adams County National Bank in Newville, PA with a balance of $2625.14. This account was later closed and a guardianship account was opened at F&M Bank. Her income was $1100 from Social Security which increased to $1140 beginning in 2012. Her largest expense, other than the nursing home, was for a life insurance which was $196.60. This was cashed in for $1960.00 and the funds were used to pay the trailer park rent. She had been several months behind and also it took several months of our working at the trailer to gather the furniture together and to clean the garbage and trash out. Only some of the furniture was in good enough condition to try to sell. It was taken to Haar's Auction and she received $550.54. The trailer was in disrepair and we would not be able to get it in to a sellable condition. We got some estimates for dismantling for salvage and that option was too expensive. We checked with the owner of the park and he agreed to discard it for her as long as we had the title and had the taxes paid up to date, which we did. Application was made for Long Term Care Medical Assistance which was approved. Ms. Nickel's major expense is Claremont Nursing and Rehab Center. Although Cumberland County Aging was authorized to collect $100 a month for a guardianship fee, we have not done that due to her limited funds. Once burial pre-arrangements are made, we will begin to so. Attached are financial summaries of LaVita Nickel's income and expenses from both accounts.
