AND NOW, this 25`f' day of April, 2012, upon consideration of the Petition under
5511 of Title 20, to Appoint a Permanent Guardian of the Person and Estate of David B.
Weaver, filed on behalf of Pauline E. Myers by Hannah Herman-Snyder, Esquire,
counsel for Petitioner, it is hereby ORDERED and DECREED:
1. An evidentiary hearing on the Petition for Appointment of Permanent
Guardian shall be held on Thursday, June 7, 2012, at 9:30 a.m., in Courtroom
No. 5, Cumberland County Courthouse, Carlisle, Pennsylvania.
2. Grace D'Alo, Esq., is appointed as counsel for David B. Weaver.
3. The Petitioner shall cause service of this Order and the attached Petition and
Citation with Notice upon David B. Weaver by serving his counsel, who is
expressly appointed to represent David B. Weaver in this matter, by first class
mail, postage prepaid or hand delivery. The contents and terms of the petition
shall be explained to the maximum extent possible in language and terms the
individual is most likely to understand. Service shall be no less than 20 days in
advance of the hearing.
4. The Petitioner shall cause service of this Order and the attached Petition and
Citation with Notice upon his next of kin who reside within Pennsylvania, his
sister, Vicki Merovich, 591-3 Geneva Drive, Mechanicsburg, Pennsylvania,
17055, by first class mail, postage prepaid or hand delivery.
5. The alleged incapacitated person shall be present at the hearing unless the
testimony of or sworn statement by a physician or licensed psychologist
satisfied the Court that his physical or mental condition would be harmed by
his presence.
6. Medical testimony may be provided at the hearing via telephone speakerphone,
provided counsel for David B. Weaver does not object, such testimony to be
arranged with the Court by counsel for the Petitioner.
