WHEREAS, Dr. Drew Stoken, of 338 Alexander Spring Road, Carlisle, Pennsylvania, 17013, is
about to enter into a contract with R. S. Mowery & Sons, Inc., of 1000 Bent Creek Boulevard,
Mechanicsburg, Pennsylvania, 17050 for the construction of an Addition and Renovations to Stoken
Ophthalmology Center located at 338 Alexander Spring Road, South Middleton Township, Carlisle,
Cumberland County, Pennsylvania.
NOW, October 6, 2004, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Dr. Drew Stoken, to the said R. S.
Mowery & Sons, Inc., to commence work on the said building, or purchase materials for the same
in consideration of the making of the said contract with R. S. Mowery & Sons, Inc., and the further
consideration of One Dollar to R. S. Mowery & Sons, Inc., paid by Dr. Drew Stoken, it is agreed that
no lien shall be filed against the building or property by the contractor, nor any subcontractor, nor
by any of the material men or workmen nor any other person for any labor, or materials purchased,
or extra labor or materials purchased for the completion of said building, the right to file such liens
being expressly waived.
