KENNETH BROWN and FRANK'S FISHERMAN, INC., Defendants IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA NO. CIVIL DIVISION - LAW COMPLAINT NOW comes the Plaintiff, by his attorneys, Wix, Wenger & Weidner, and sets forth as follows: 1. The Plaintiff is an adult individual residing at 2751 Allen Glen Drive, Mechanicsburg, Pennsylvania 17055 2. Defendant Kenneth Brown is an adult individual who is employed by Defendant Frank's Fisherman, Inc. at 366 Jefferson Street, San Francisco, California 94133. 3. Defendant Frank's Fisherman, Inc. is a corporation having its principal offices located at 366 Jefferson Street, San Francisco, California 94133. 4. At all times relevant hereto, Defendant Brown was the agent, servant and employee of Defendant Frank's Fisherman, Inc. and acting within the scope of such employment or agency. 5. At all times relevant hereto Defendants were engaged in the sale of maritime antiques, including scrimshaw teeth. 6. On or about September 29, 2004, Defendant Brown represented to Plaintiff that two scrimshaw teeth that he was selling to the Plaintiff were 19th Century antique scrimshaw teeth. 7. Plaintiff believing the representations made to him by Defendant Brown agreed to purchase the two scrimshaw teeth for the total sum of $7,500.00, which was tendered to the Defendants. 8. Plaintiff believes and therefore avers that the Defendant ships merchandise to Pennsylvania and otherwise engages in business in Pennsylvania. 9. Early in 2011, Plaintiff learned for the first time from another expert that the teeth sold to him by the Defendants were modern and not antique scrimshaw and worth only a fraction of the amount that Plaintiff paid for the teeth. COUNTI Craig Lahar v. Ken Brown and Frank's Fisherman, Inc. Breach of Contract 10. Plaintiff incorporates herein by reference paragraphs 1 through 9 of this Complaint. 11. Defendants breached the contract in that the teeth sold to the Plaintiff were not antique scrimshaw. WHEREFORE, Plaintiff demands judgment against the Defendants in an amount not in excess of mandatory arbitration limits. 2 COUNT II Craig Lahar v. Ken Brown and Frank's Fisherman, Inc. Misrepresentation 12. Plaintiff incorporates herein by reference paragraphs 1 through 11 of this Complaint. 13. Defendant misrepresented the merchandise being sold to the Plaintiff. 14. Plaintiff reasonably relied upon the representations of the Defendants. 15. Plaintiff has sustained damages as a result of Defendants' misrepresentations.
