MINICH, Deceased --~ Late of Middlesex Township, Cumberland County, Pennsylvania ~~ PETITION TO AMEND FIRST AND FINAL ACCOUNT NUNC PRO TUNC AND NOW comes the Executrix by and through her attorney, Michael L. Bangs, Esquire and files the following Petition to Amend First and Final Account Nunc Pro Tunc based upon the following: 1. A First and Final Account of Kimberly L. Rhoades, Executrix for the Estate of Nelson L. Minich, was filed on May 17, 2012. Attached hereto and marked as Exhibit A is a true and correct copy of the First and Final Account. 2. After the First and Final Account was filed and the Executrix received her time- stamped copy, she immediately notified Michael L. Bangs that Page 4 of the First and Final Account was missing and that the filed Page 4 was simply a duplicate of Page 6. 3. Upon review of the First and Final Account, it appears that an error was made in compiling the accounting and that in fact Page 4 is the same as Page 6. 4. The actual Page 4 of the First and Final Account that should have been included in the filed document is attached hereto and marked as Exhibit B. 5. The First and Final Account is scheduled for disposition by the Court on June 19, 2012 and as such had to be filed on or before May 18, 2012. 6. Rather than withdraw the First and Final Account and file another one, the Executrix by and through her attorney is requesting that this Honorable Court simply allow the amendment of the First and Final Account such that Exhibit B will replace the existing Page 4 of the accounting. 7. The amendment is occurring after the last date of the permitted filing and the Executrix through her attorney is asking that the Court allow this amendment nunc pro font. 8. All of the heirs have been sent a copy of this proposed amendment. WHEREFORE, the Executrix requests this Honorable Court to order and direct the following: A. The First and Final Account of Kimberly L. Rhoades, Executrix, filed on May 17, 2012 is hereby amended such that Page 4 is replaced with Exhibit B which will become a part of the First and Final Account of Kimberly L.
