FINDINGS OF FACT: 1. The claimant was last employed for more than one year with Blue Beacon USA and the claimant last worked for the employer as a full time bay attendant earning $10.25 per hour on December 4, 2009. 2. The employer's business. is a tractor and trailer truck wash. 3. The claimant's job duties included washing trucks. 4. The employer became aware the claimant was arrested and on December 3, 2009, the employer questioned the claimant about his arrest and the claimant made statements including a statement that he head butted a police officer to defend himself and that he urinated in the police car. The claimant also stated that charges against him were not true. 5. The incident which caused the claimant's arrest was not during the claimant's work hours and was not on employer property. 6. The claimant's place of employment was not stated in the news article of his arrest. 7. The employer's policy provides "Violence will not be tolerated at Blue Beacon. Employees may not carry a weapon while at work. Any employee who engages in a physical altercation (other than to reasonably defend himself/herself) or threatens violence may be terminated from employment. Likewise, verbal abuse will not be tolerated at Blue Beacon. Any employee verbally abusing another person may be terminated from employment." Ci2imant --TONY L ROBINSON Appeal - 10-09-F-0837 8. The claimant was aware of the employer's policy. 9. On December 4, 2009, the claimant was discharged from work due to his alleged violation of a company work rule. 10. The claimant has not been convicted of any of the charges against him. ISSUE: At issue in this appeal is whether the claimant's alleged violation of an employer work rule constitutes willful misconduct in connection with the work. REASONING: The Pennsylvania UC Service Center issued a determination disapproving benefits under Section 402(e) of the Pennsylvania Unemployment Compensation Law. Section 402(e) of the Law provides that a claimant shall be ineligible for compensation for any week in which his unemployment is due to his discharge or temporary suspension from work for willful misconduct connected with his work. Willful misconduct has been defined as an act of wanton or willful disregard of the employer's interests, a deliberate violation of the employer's rules, a disregard of the standards of behavior which the employer has a right to expect of an employee, or negligence indicating an intentional disregard of the employer's interests or of the employee's duties and obligations to the employer. The Referee wishes to emphasize that in cases where an individual is discharged from employment, the employer bears the burden of proving that the discharge was the result of the individual's willful misconduct in connection with his work and this burden must be satisfied with competent testimony. Where an individual' is discharged from employment for the violation of an employer rule, the burden is upon the employer to prove the existence of-.the . rule and that it was violated;. then the burden of proof shifts-to-the Llaimant.to. prove_good_,. cause for the violation or that the rule was unreasonable. In this case, the claimant was discharged from work due to an alleged violation of an employer work rule. The claimant was involved in an off duty incident outside of the workplace and the claimant admitted to the employer that he head butted a police officer to defend himself. The employer's policy provides that "Violence will not be tolerated at Blue Beacon" and that "Employees may not carry a weapon while at work." The employer's policy directs the employee's behavior while at work and does not direct his off duty conduct. The claimant's off duty conduct did not affect his ability to continue working as a bay attendant and the off duty arrest and charges against the claimant were not material to his employment. Under these circumstances, the referee concludes the claimant's termination did not result from his willful misconduct which was connected to his work. And, therefore, unemployment compensation benefits will not be denied to the claimant under Section 402(e) of the Law. ORDER: The determination of the UC Service Center is reversed. Claim credit for waiting week ending December 12, 2009 is allowed.
