WHEREAS, ?Abdul M. Moosa of 3 Royal Palm Drive, Mechanicsburg, PA 17055, is about to
execute contemporaneously herewith, a contract, with Carlson Construction, Inc. of 1208
Summit W Mechanicsburg, PA, for the erection of a building upon premises commonly
known as28 Summit Way, Township of Hampden, Cumberland County, Pennsylvania, as
set forth i the deed dated 07/18/11, recorded at Instrument Number 201120413, in the
Recorder' Office for Cumberland County, Pennsylvania, as more specifically described in
Exhibit "A' which is incorporated herein and attached hereto.
NOW, M 24, 2012, at the time of and immediately before the execution of the principal
contract, d before any authority has been given by the said Owner to the said Contractor
to comm ce work on the said building, or purchase materials for the same in consideration
of the ma ng of the said contract with Contractor and the further consideration of One Dollar
($1.00), contractor paid by Owner, it is agreed that no lien shall be filed against the
building the Contractor, or any subcontractor, nor by any of the materialmen or workmen
or any t er person for any labor, or materials purchased, or extra labor or materials
purchas for the erection of said building, the right to file such liens being expressly
waived. 1

ALL THAT CERTAIN tract or parcel of land being situate in Hampden Township,
Cumberland) County, Pennsylvania, more particularly bounded and described as follows:
BO:SINNING at a point on the southern right-of-way line of Summit Way (50' wide) at the
northwest corner of Lot 32 of the hereinafter referenced Plan; thence along the western line of Lot
32, South 212 degrees 13 minutes 55 seconds East, a distance of 150.40 to a point at the southwest
corner of Clot 32 and along the northern line of OS-I on said Plan; thence along the northern line of
OS-1, Soutih 70 degrees 53 minutes 35 seconds West, a distance of 107.31 feet to a point at the
southeast corner of Lot 34; thence along the eastern line of Lot 34, North 22 degrees 13 minutes 55
seconds West, a distance of 137.27 feet to a point on the southern right-of-way of Summit Way;
thence along Summit Way, North 67 degrees 46 minutes 05 seconds East, a distance of 57.21 feet to
a point; thence continuing along the same, by a curve to the left having a radius of 175.00 feet and
an arc length of 50.65 feet to a point, the point and place of BEGINNING.
CONTAINING 15,142 sq. ft. or 0.35 acre having an address of 1428 Summit Way,
Mechanicsburg, Pennsylvania 17050.
ALSO BEING Lot 33 as shown on the plan entitled, "Final Subdivision Plan for Hampden
Summit Phase 4", prepared by R. J. Fisher and Associates, Inc., recorded in the Office of the
Recorder of Deeds for Cumberland County, Pennsylvania in Plan Book 94, Page 52.
UDDER AND SUBJECT, NEVERTHELESS, to all easements, restrictions, encumbrances
and other matters of record or that which a physical inspection or survey of the premises would
reveal.
