Patel, hereinafter called the Owner, is about to execute contemporaneously with Keystone Custom Homes, Inc. of 227 Granite Run Drive, Suite 100, Lancaster, PA 17601, hereinafter called the Contractor, a contract for the erection or construction of a SINGLE FAMILY DWELLING upon the lot of ground known as 22 Hunt Place, Mechanicsburg, PA 17050, Foxwood, Silver Spring Township, Cumberland County, Pennsylvania, described in Exhibit "A" hereof, of which Natvarbhai A. Patel is the title holder of record, as more particularly described in Deed Book , Page _;and ,Qota, May 30, 2012, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the Owner to the Contractor to commence work on said building or improvement, to purchase materials for the same, it is hereby stipulated and agreed by and between said parties as part of said contract and for the consideration therein set forth, nether the undersigned Contractor, any Sub-contractor or material man, nor any other person furnishing labor or materials to the said Contractor under the contract entered into between said parties shall file a lien for work done or material furnished to said building, improvements or any part thereof. Tbig stipulation is made and intended to be filed with the Prothonotary within 10 days after date in accordance with the requirements of the Act of August 24, 1963, P.L. 497, as amended, In Vitnegg Whereof, the said parties have hereunto set their hands and seal the day and year aforesaid. All that land or tract of ground situate in Silver Spring Township, Cumberland County, PA, more particularly bounded and described as follows, to wit: Beginning at a point on the northern right-of-way line of Mulberry Drive at a southern corner of Lot #5; thence along said northern right-of-way line S46-45-12W 21.46 feet to a point; thence along the same, along a 50' drainage easement, through a 50' Atlantic Pipeline Easement and through Trindle Spring Run by a curve to the right, said curve having a chord bearing and distance of S61-37-25W 64.16 feet, a radius of 125.00 feet and an arc distance of 64.88 feet to a point; thence along the same, through said easement, and along an existing 30' sanitary sewer easement S75-12- 57W 159.59 feet to a point being an eastern corner of Lot #1 at a drainage easement; thence along Lot #1, along said drainage easement, through said 50' Atlantic Pipeline Easement and along Lot #3 N09-30-11 E 196.65 feet to a point on the southern right- of-way line of Hunt Place; thence along said right-of-way line S80-29-49E (Erroneously set forth as S79-55-44E in Plan Book 90, Page 18) 45.34 feet to a point; thence along the same by a curve to the left, said curve having a chord bearing and distance of N73-07-41 E 44.42 feet, a radius of 50.00 feet and an arc distance of 46.03 feet to a point being a southern corner of Lot #5; thence along Lot #5, through an existing 30' sanitary sewer easement, through a 50' drainage easement, and through Trindle Spring Run S43-14-48E 155.73 feet to a point, being the place of beginning. Containing 27,568 square feet. (0.63 acres) Being Lot #4 on a Preliminary Final Subdivision Plan for Foxwood, prepared by R. J. Fisher and Associates, Inc., and recorded in Plan Book 90, Page 18. BEING THE SAME PREMISES which Ronny R. Anderson, Sheriff of the County of Cumberland, in the Commonwealth of Pennsylvania, by deed recorded February 9, 2010 in the Office of the Recorder of Deeds in and for the County of Cumberland, Pennsylvania, at Instrument Number 201003468 granted and conveyed unto Triple Crown Corporation, Inc., a PA Corporation.
