WHEREAS, ROGER A. PLACE and CYNTHIA K. PLACE, husband and wife, of Mechanicsburg, Pennsylvania, is about to
execute contemporaneously herewith, a contract with FOXBUILT, INC., of 5755 Union Deposit Road, Harrisburg, Pennsylvania, for
the erection of a residential building upon a lot of land situate as follows:
ALL THAT CERTAIN tract of real estate lying and being situate the Township of Silver Spring, Cumberland County,
Pennsylvania, bounded and limited as follows:

BEGINNING at an iron pin found located on the northerly right-of-way line of Wertzville Road at lands now or formerly
of Corey Es)inger and Joyce Eslinger; thence along said northerly right-of-way line of Wertzville Road, North 88 degrees
01 minute 30 seconds West 74.25 feet to a point located at Lot # I (Tract No. I herein); thence along said Lot #1, North 01
degree 58 minutes 30 seconds East 1,069.71 feet to an iron pin set; thence continuing along the same, North 53 degrees 59
minutes 27 seconds East 573.44 feet to a point located at Lot #2 as shown on the herein referred to plan; thence along said
Lot #2, South 36 degrees 00 minutes 33 seconds East 639.01 feet to a point located at lands now or formerly of Jerry L.
Estep and Cindy Estep (said point being North 27 degrees 21 minutes 21 seconds West 49.99 feet from an iron pin
found); thence along said lands now or formerly of Jerry L. Estep and Cindy Estep, North 88 degrees 59 minutes 52
seconds West 220.17 feet to an iron pin found; thence continuing along the same, South 44 degrees 37 minutes 21
seconds West 453.59 feet to an iron pin found; thence continuing along the same, South 01 degree 19 minutes 13 seconds
West 390.90 feet to an iron pin found at lands now or formerly of Robert E. Foose and Freda K. Foose; thence along said
lands now or formerly of Robert E. Foose and Freda K. Foose, and along lands now or formerly of Corey Eslinger and
Joyce Eslinger, North 87 degrees 55 minutes 40 seconds West 250.02 feet to an iron pin found; thence continuing along
said lands now or formerly of Corey Eslinger and Joyce Eslinger, South 01 degree 19 minutes 13 seconds West 191.17
feet to an iron pin found located on the northerly right-of-way line of Wertzville Road, the place of BEGINNING.
BEGINNING Proposed Lot #4 and CONTAINING 12.53 acres as shown on that certain Final Subdivision Plan for Stone
Hill Estates, Silver Spring Township, Cumberland County, Pennsylvania, dated January 13, 2011, as revised March 18,
2011, June 18, 2011, and September 30, 2011, prepared by Alpha Consulting Engineers, Inc., and recorded in the Office
of the Recorder of Deeds for Cumberland County, Pennsylvania, as Instrument No. 201201302.
IT BEING the same premises which R.L.P. Properties, LLC, a Pennsylvania Limited Liability Company, by its Deed
dated November 18, 2011, and recorded in the Recorder of Deeds Office of Cumberland County as Instrument Number
201201468, granted and conveyed unto Roger A. Place and Cynthia K. Place, husband and wife, the MORTGAGORS
herein.
NOW, May 2, 2012, at the time of and immediately before the execution of the principal contract, and before any authority
has been given by the said ROGER A. PLACE and CYNTHIA K. PLACE to the said FOXBUILT, INC., to commence work on the said
building, or purchase materials for the same in consideration of the making of the said contract with FOXBUILT, INC., and the
further consideration of One Dollar, to FOXBUILT, INC., paid by ROGER A. PLACE and CYNTHIA K. PLACE, it is agreed that no lien
shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any

other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to
file such liens being expressly waived.
