Young, Executor of the Estate of Arthur H. Lentz, Deceased, by and through his counsel, and responds to the Rule to Show Case issued on May 22, 2012 and avers as follows: 1. Admitted 2. Admitted 3. Admitted. By way of further answer, Petitioner was granted a Durable Power of Attorney by Decedent on June 24, 2009. Such grant continued until Decedent's death. 4. This paragraph requires no response. 5. Admitted. 6. Denied. 7. Admitted. 8. Admitted. 9. Admitted as of the filing of the Petition. By way of further answer, an inventory of the Estate is provided with this Response. 10. Admitted as of the filing of the Petition. Concurrent with this filing, the Executor has submitted a status report to the Register of Wills and served a copy of same on the Petitioner. 11. Paragraph 11 is a statement of law to which no response is required. 12. Admitted. By way of further answer, the Executor has exercised due diligence in inventorying and valuing the assets of the Estate. 13. Denied to Paragraph as stated. By way of further answer, the Executor has exercised due diligence in inventorying and valuing the assets of the Estate, has made a determination that the Estate is without sufficient cash assets to pay claims against the Estate, has made a determination that the truck bequeathed to Petitioner is the asset of single greatest value in the Estate, and (concurrent with this Response) petitioned the Orphans' Court to permit the sale of the truck. 14. Denied. By way of further answer, the Executor has exercised due diligence in inventorying and valuing the assets of the Estate and has made a determination that the Estate is without sufficient cash assets to pay claims against the Estate. 15. Paragraph 15 is a statement of relief to which no response is required. NEW MATTER 1. Decedent was an illiterate gentleman. Decedent's wife Betty Lentz assisted Decedent with his business and medical affairs until her death in March 2008. Decedent granted his natural daughter Debbie Bomberger a Power of Attorney and Durable Medical Power of Attorney on August 23, 2007 for the purpose of having his daughter provide similar assistance. Decedent granted Petitioner a Durable Power of Attorney on June 24, 2009, which powers she exercised until Decedent's Death. 2. Upon information and belief, Decedent resided with Petitioner from August 2.009 until his death and kept his personal property at the shared residence. 3. Decedent's Will named as beneficiaries Petitioner ("grandfather clock and truck"); Albert Largent ("all of my tools, lawn mowers and equipment"); and Douglas C. Young (Estate remainder). 4. From the time of Decedent's death, Douglas C. Young (Executor or Mr. Young) has exercised due diligence to inventory and value the personal property of the Decedent. In support thereof, attached hereto and marked ATTACHNtENT A is the Affidavit of Douglas Young. 5. Despite the exercise of due diligence, Mr. Young remains unable to account fir the following personal property, including cash assets, of the Decedent: Shivvers Country Clipper mower valued at $6,566.00 and listed as covered equipment in a tradesman insurance policy issued by Goodville Mutual Casualty Company to Arthur Lentz t/a Pete's Lawn Care; $600.0() security deposit paid by tenants Bradley and Debbie Hoak relating to a lease entered into with Decedent in his capacity as the holder of a life estate in property located at 1115 Strites Road, Middletown, Pennsylvania; and Judgment in the amount of $2,153.92 ordered by District Justice Michael J. Smith, Magisterial District 12-2-01 on Complaint filed by Decedent and Petitioner, Co-Plaintiffs, on July 21, 2010 at Docket No. LT-0000469-10, seeking unpaid rent from Robert and Sharon Eshelman. Upon information and belief, Decedent, in his capacity as the holder of a life estate in property located .at 1115 Strites Road, Middletown, Pennsylvania, entered into a residential lease with the Eshelmans. 6. On behalf of Mr. I'oung, the firm of Robert W. Morris and Co., PC, prepared the Inheritance Tax Return which indicates that the Estate inheritance tax due and payable is $2,258.39. Also offered in support thereof attached and marked as ATTACHMENT B is the Affidavit of Debbie Bomberger. 7. The asset of single greatest value in the Estate under the control of the Executor is the 2008 (2 wheel drive) Ford F-150, appraised at $10,000, which was the subject of the bequest to Petitioner (Truck). 8. Based on the foregoing, the Estate has insufficient cash assets to pay the Estate's expenses and claims, including the inheritance tax. 9. Based on the foregoing, the Executor believes that the remaining Estate assets, including those assets that are the subject of specific bequests, need to be sold for their cash value to be applied to the Estate expenses and claims. 10. By separate concurrent filing, the Executor has petitioned the Orphans' Court to authorize the sale of the Truck for application of its cash value to the Estate expenses and claims. 11. Executor expects to file the formal accounting and to complete the administration of the Estate and distribution of the Estate assets within 30 days of the Orphans' Court grant of the Petition for sale of the Truck. Young, affirm the following: 1. I am the natural grandchild of Arthur Lentz. 2. Arthur Lentz informed me that he had named me the Executor of his estate in his Will dated July 10, 2009. 3. Arthur Lentz died on March 29, 20l 1 after a short hospitalization. 4. Upon information and belief, prior to his death, Arthur Lentz resided at 207 Edna Street, Wormleysburg, Cumberland County, Pennsylvania, with property owner Betty Gingrich. 5. I began performing my duties as Executor upon the death of Arthur Lentz on. March 29, 2011. 6. As Executor, I secured a Short Certificate from the Cumberland County Register of Wills on April 1, 2011. 7. Arthur Lentz granted Betty Gingrich a Durable Power of Attorney on June 24, 2009. 8. As Executor, on March 29, 2011 I requested a copy of Arthur Lentz's Will from Betty Gingrich as holder of his power-of-attorney and with whom he resided prior to his hospitalization and death. 9. Ms. Gingrich delivered a copy of the Will, dated July 10, 2009, to me through his then legal counsel. 10. As Executor, I prepared an inventory of the assets of the Estate of Arthur Lentz (APPENDIX A~. 11. On March 29, 2011, I requested that Ms. Gingrich release all financial records relating to the Estate of Arthur Lentz. Thereafter, I sporadically received the requested records. 12. On March 29, 2011, I requested that Ms. Gingrich release the personal property of Arthur Lentz believed to be at her residence. 13. Upon agreement with Ms. Gingrich as to the time and place, I appeared at the home of Ms. Gingrich on May 16, 2011, to take possession of Arthur Lentz's personal property. Ms. Gingrich independently made arrangements for a Constable to be present and to oversee the transfer of Arthur Lentz's personal property from Ms. Gingrich's possession to my possession as Executor. 14. Certain personal property known to be in the possession of Arthur Lentz at the time of his death were not made available by Ms. Gingrich on May 16, 2011. 15. Thereafter, certain additional personal property was sporadically delivered by Ms. Gingrich through her then legal counsel to me. 16. Prior to his death, Arthur Lentz held a life estate in real property located at 1115 Strites Road, Middletown, Pennsylvania, at which he had lived with his wife Betty J. Lentz before and for a period of time after her death in March 2008 and whi<;h he had deeded to his natural daughter, Debbie Bomberger, and her husband (Proper):y) in August 2008. 17. On August 30, 2010, Arthur Lentz leased the Property to Bradly and Debbie Hoak, subject to a security deposit of $600.00 (APPENDIX B). 18. The $600.00 security deposit was not found among Arthur Lentz's personal assets nor re eased by Ms. Gingrich to me. 19. Upon information and belief, Ms. Gingrich did not return the $600.00 security deposit directly to the Hoaks following Arthur Lentz's death and termination of his life estate in the Property. 20. From 2009 until Arthur Lentz's death on March 29, 2011, Debbie and Michael Bomberger paid real estate taxes, solid waste collection service charges, and electric service charges and maintained property insurance for the Property (APPENDIX C). 21. Prior to his death, Arthur Lentz was the sole proprietor of a lawn care business trading under the name Pete's Lawn Care. 22. Arthur Lentz owned and used several mowers and other equipment in the lawn care business. 23. On April 4, 2010, Arthur Lentz purchased a Shiwers Country Clipper mower from Central Hardware Lawn and Garden for the price of $6,566.70 (APPENDIX D). 24. Arthur Lentz maintained a tradesman insurance policy for Pete's Lawn Care with Goodville Mutual Casualty Company. 25. A renewal of the tradesman insurance policy dated March 28, 2011, listed a "Shiwers Manufacturing Country Clipper" mower valued at $6,566.00 as covered equipment (A.PPENDIX E). 26. The Country Clipper mower was not among the personal property of Arthur Lentz transferred by Ms. Gingrich to me on May 16, 2011. Despite the exercise of reasonable due diligence, the Country Clipper mower has not thereafter been located by me or transferred to me by Ms.Gingrich. 27. Arthur Lentz owned a 2008 (2 wheel drive) Ford F-150 truck at the time of his death (Truck). 28. As Executor, I took possession of the Truck when I took possession of Arthur Lentz's other personal property. 29. At the time of Arthur Lentz's death, the truck was in fair condition (APPENDIX F). 30. As Executor, I had the truck appraised by Maguires Ford of Duncannon. Maguires Ford appraised the truck at $10,000 (APPENDIX G). 31. As Executor, I have paid outstanding bills and claims owing on the Estate, excepting they referenced $600.00 security deposit and the Property expenses paid by the Bambergers. 32. As Executor, I have accounted for and valued all of Arthur Lentz's personal property and cash assets at the time of his death, excepting the $600.00 security deposit and the Country Clipper mower valued at $6,566.00. 33. As Executor, I have accounted for all outstanding claims on the Estate, including tax obligations in the amount of $2,258.39, as identified in the Inheritance Tax Return prepared by Robert W. Morris and Company, PC and dated June 7, 2012 (APPENDIX H). 34. The outstanding claims on the Estate exceed the value of the Estate assets remaining in my possession. I understand that false statements herein are made subject to the penalties of 18 Pa.C.S. Section 4904, relating to unsworn falsification to authorities. Bomberger, affirm the following: L I am the natural daughter of Arthur Lentz, deceased as of March 29, 2011. 2. Arthur Lentz was an illiterate gentleman. 3. Arthur Lentz was diagnosed with and under treatment for diabetes, arthritis, macular degeneration, carotid arteries and heart triple bypass. 4. Arthur Lentz was the sole owner and operator of a lawn care business trading as Pe~te's Lawn Care. 5. Following the death of Betty J. Lentz, Arthur Lentz's wife and my mother on March 7, 2008, I and my husband, Michael Bomberger, assisted Arthur Lentz in matters relating to his health care and business records. 6. Arthur Lentz granted me Power-of-Attorney and Durable Medical. Power-of-Attorney on. August 23, 2007. 7. Arthur and Betty J. Lentz resided at 1115 Strites Road, Middletown, Pennsylvania (Property). 8. On August 26, 2008 Arthur Lentz deeded the Property to me and my husband Michael Bomberger in fee, retaining a life estate in the Property. The Deed was recorded in the Dauphin County Recorder of Deeds on August 28, 2008 at Instrument #20080032266. The life estate clause provided for no exceptions to the legal. duties of Mr. Lentz as possessor and occupant of the Property (APPENDIX A). 9. Arthur Lentz exercised his rights in the life estate in the Property until his death on March 29, 2011. 10. On June 24, 2009, Arthur Lentz, through his then legal counsel, verbally requested that I no longer assist in the management of his business and medical affairs. 11. On June 24, 2009 Arthur Lentz granted a Durable Power-of-Attorney to Betty Gingrich. Upon inquiry, I was informed by his then legal. counsel that the Power-of- Attorney included both financial and medical matters. 12. Upon information and belief, on or about August 2009 Arthur Lentz began residing at the home of Betty Gingrich. 13. Thereafter, Arthur Lentz rented the Property to Robert and Sharon Eshelman. 14. Upon information and belief, the Eshelmans failed to pay rent and on July 21, 2010, Arthur Lentz filed a Landlord and Tenant Complaint against the Eshelmans for unpaid rent (Docket No. LT-0000469-10). Ms. Gingrich was named as a co-plaintiff in the Complaint and alone signed the Complaint. Arthur Lentz alone signed a Request for Order of Possession. 15. By Order for Possession, Return and Notice dated August 13, 2010, District Justice Michael J. Smith, Dauphin County, ordered the Eshelmans to vacate the Property and granted judgment against the Eshelmans in the amount of $2,153.92 (Judgment). 16. Upon information and belief, no further action was taken by Arthur Lentz or Ms. Gingrich, under her Power-of-Attorney, to collect the Judgment. 17. On or about May 30, 2010, Arthur Lentz rented the Property to Bradley and Debbie Hoak, subject to a $600.00 deposit. 18. Th,e Hoaks rented the Property from Arthur Lentz until the date of his death. 19. Arthur Lentz did not pay the real estate taxes on the Property for the years 2010 through his death in March 29, 2011 and did not pay the school taxes on the Property for the years 2009 through his death in March 29, 2011. 20. Arthur Lentz did not pay the waste collection service charges on the Property from Ocaober 2009 through March 29, 2011. 21. Arthur Lentz did not pay electric utility service charges for the Property from. April 13 to April 16, 2010. 22. Arthur Lentz discontinued homeowner insurance on the property on July 20, 2009. 23. I paid the above-described taxes, waste collection service charges, electric utility service charges and homeowner insurance for the Property during the periods when Arthur Lentz did not do so. I paid the taxes and utility service charges for the purposes of keeping the Property current on its obligations. I maintained homeowners insurance on the Property as a prudent precaution against loss (APPENDIX B). I understand that false statements herein are made subject to the penalties of 18 Pa.C.S.
