Beard, both adult individuals, are husband and wife currently residing at 21 Wooded Drive, Shippensburg, Pennsylvania, 17257. 2. Defendant Dwayne A. Sollenberger is an adult individual last known to be residing at 17 Wooded Drive, Shippensburg, Cumberland County, Pennsylvania 17257 (hereinafter the "Premises"), more fully described in the legal description attached hereto and incorporated herein as Exhibit "A". 3. Plaintiffs are the record owners of the Premises where Defendant resides, having acquired title by Deed dated February 10, 2011. See Exhibit „A„ 4. The Deed conveying the Premises to Plaintiffs was acknowledged by Edward J. Peck and Sandra R. Peck, husband and wife, the former owners on February 10, 2011, and was duly recorded in the Cumberland County Recorder of Deeds' office on March 8, 2011. Id. COUNT I - EJECTMENT 5. The foregoing paragraphs are incorporated as though if fully set forth at length herein. 6. Despite repeated demands, Defendant refuses to vacate the Premises. 7. Defendant has no valid legal right to possession of the Premises. 8. Plaintiffs demand the right of possession of the Premises to the exclusion of the Defendant and anyone found with Defendant. WHEREFORE, Plaintiffs seek judgment for possession of the aforesaid Premises to the exclusion of Defendant. COUNT 11- UNJUST ENRICHMENT 9. The foregoing paragraphs are incorporated as though if fully set forth at length herein. 10. Defendant continues to reside at the Premises to Plaintiffs' detriment. 11. Plaintiffs would be able to collect rent from a tenant if Defendant would vacate the Premises since he has no legal right to remain. 12. Plaintiffs believe and therefore aver that they could lease the Premises for at least $900.00 per month. 13. Defendant is unjustly enriched by remaining at the Premises where he has no legal right to remain without payment. 14. Plaintiffs cannot be compelled to rent the Premises to an individual whom they would not approve. WHEREFORE, Plaintiffs requests damages in the amount of the $900.00 per month, plus interest, for the length of time that Defendant stays at the Premises despite having no legal authority to remain. COUNT III - CONVERSION 15. The foregoing paragraphs are incorporated as though if fully set forth at length herein. 16. Defendant continues to remain at the Premises despite having no legal right to remain. 17. On or about May 28, 2012, it is believed and therefore averred that Defendant caused damage to the home including damage to the redwood deck. 18. Also, on or about May 28, 2012, it is believed and therefore averred that Defendant caused damage when he pressure washed the home. 19. Plaintiffs obtained an estimate to repair the damages and said estimate is attached hereto as Exhibit B. 20. Defendant's actions have been without Plaintiffs' authority and Plaintiffs have suffered damages. Wherefore, Plaintiffs request damages in an amount less than the mandatory arbitration limits of $50,000.00 as a result of damages caused by Defendant to the Premises while he remains in possession without legal authority.
